循环型社会构建的经济法保障机制研究

【摘要】： 循环型社会是以循环经济为基本经济发展模式、人与自然和谐发展的社会形态,是完全符合可持续发展主体要求的发展状态,其与循环经济有密切的联系。循环型社会为循环经济提供意识形态给养与制度规则,从而使之可能成为真正的生态经济。循环经济只有纳入循环型社会建设并成为其基础,才能真正符合可持续发展的时代要求。各国经济发展的历程证明,构建循环型社会已经成为人类社会可持续发展的必然选择。循环型社会构建兴起于经济发达国家,其中尤以日本、德国为典型,两国在循环型社会构建过程中形成了自己的特色,但也有相似之处,而这正是我国最值得借鉴的部分。国际社会建设循环型社会的实践证明,循环型社会的构建是一个系统工程,需要多层次的社会支撑体系。在当今法治社会,通过法律手段固定并表达这一系统则成为我国循环型社会构建的重要保障。循环型社会构建的法制保障过程是一个多法律部门协同的过程,各法律部门不可或缺,发挥着独特的作用。但各部门法在其中的作用程度亦存在差别,本文意在探寻在我国循环型社会构建过程中起主导作用的法律部门。由于我国特殊的政治传统及循环型社会构建过程中较强的“外部性”,经济法以其解决“市场失灵”、“政府失灵”方面的双重优势而与循环型社会构建具有更强的契合性,这决定了经济法将在循环型社会的法制保障中发挥更重要的作用。结合循环型社会的特点及经济法的特性,本文将循环型社会构建划分为有机的三个部分:国家推进机制、市场调节机制及社会参与机制。三部分协调一致,形成有效互动,进而共同为循环型社会构建提供保障。
[Abstract]:Circular society is a kind of society which takes circular economy as the basic mode of economic development and harmonious development between man and nature. It is a state of development that fully meets the requirements of the subject of sustainable development. It has close relation with circular economy. Circular society provides ideology supply and system rules for circular economy. So as to make it possible to become a true ecological economy. Circular economy only into the circular society construction and become its foundation, can truly meet the requirements of sustainable development of the times. Building a circular society has become an inevitable choice for the sustainable development of human society. The construction of circular society rises in the developed countries, especially Japan and Germany. The two countries have formed their own characteristics in the process of the construction of circular society, but there are also similarities. This is the most valuable part of our country. The practice of the international community to build a circular society has proved that the construction of a circular society is a system engineering, needs a multi-level social support system, in today's rule of law society. Fixing and expressing this system through legal means has become an important guarantee for the construction of circular society in our country. The legal guarantee process of the circular society construction is a process of the coordination of various legal departments. The legal departments are indispensable and play a unique role, but the degree of the role of the various branches of law in which there are differences. The purpose of this paper is to explore the legal departments that play a leading role in the construction of a circular society in our country. Due to the special political tradition of our country and the strong "externality" in the construction process of the circular society. With its dual advantages of "market failure" and "government failure", economic law has a stronger agreement with the construction of circular society. This determines that economic law will play a more important role in the legal guarantee of circular society. Combined with the characteristics of circular society and the characteristics of economic law, this paper divides the construction of circular society into three parts: national promotion mechanism, market regulation mechanism and social participation mechanism. Form effective interaction, and then provide a common guarantee for the construction of a circular society.
