环境职务犯罪防控机制研究

【摘要】： 环境是人类赖以生存的前提,现在环境遭到了前所未有的破坏,而且破坏还在延续,程度还在加重,我们将环境犯罪直接嫌疑人绳之以法,但还是屡禁不止,而且愈演愈烈。经过对黑龙江某基层法院和检察院2006—2009年环境犯罪案件分析,调查的细节发现这些案件背后与一些环境监管的工作人员玩忽职守、滥用职权甚至徇私舞弊、钱权交易具有直接的关系。为此,本文对环境职务犯罪的防控机制进行了研究,希望环境职务犯罪能得到有效控制,这种高发态势得到遏制。首先,通过对我国环境职务犯罪的现状调查发现,我国虽然已经建立了环境职务犯罪防控机制,现状表明这种防控机制存在立法机制、执法机制、司法机制、监督机制和教育机制的不足,并对其进行了分析。其次,对国外环境职务犯罪防控机制的借鉴,如西班牙的严密立法、新加坡的严格执法、韩国完善的司法、巴西的舆论监督和芬兰注重的职业道德进行了评述。通过对国外的先进经验进行学习,对我国环境职务犯罪的防控机制有所借鉴。最后,对完善我国环境职务犯罪防控机制提出构想。完善环境职务犯罪的刑事立法机制；发挥检察机关职权完善执法机制；增强环境职务犯罪司法机制；强化环境职务犯罪监督机制；深入环境职务犯罪教育机制。通过对环境职务犯罪防控机制的完善,注重标本兼治,综合治理,着力形成环境监管人员不能,不敢,不想实施职务犯罪的有效机制。建立健全我国环境职务犯罪防控机制,减少因环境监管人员的渎职而引发的犯罪,必将减少环境犯罪的发生。
[Abstract]:The environment is the premise of human survival, now the environment has suffered unprecedented damage, and the damage is continuing, the extent is still aggravated, we will be directly suspected of environmental crimes brought to justice, but still repeated prohibitions. And intensified. After a grass-roots court and procuratorate in Heilongjiang from 2006 to 2009 analysis of environmental crime cases. The details of the investigation found that these cases were directly related to the negligence of some environmental regulatory staff, abuse of power or even favoritism, and money trading. In this paper, the prevention and control mechanism of environmental duty crime is studied, and it is hoped that the environment duty crime can be effectively controlled, and this high incidence situation can be contained. First of all, through the investigation of the current situation of environmental duty crime in China, we found that although our country has established the environmental duty crime prevention and control mechanism, the current situation shows that this kind of prevention and control mechanism exists legislative mechanism, law enforcement mechanism, judicial mechanism. The deficiency of supervision mechanism and education mechanism is analyzed. Secondly, the reference of foreign environmental duty crime prevention and control mechanism, such as Spain's strict legislation, Singapore's strict law enforcement, South Korea's perfect judiciary. The supervision of public opinion in Brazil and the professional ethics of Finland are reviewed. By studying the advanced experience of foreign countries, we can learn from the prevention and control mechanism of environmental duty crime in our country. Finally. To perfect our country environmental duty crime prevention and control mechanism proposes the idea, consummates the environment duty crime criminal legislation mechanism; Giving full play to the power of procuratorial organs and perfecting the law enforcement mechanism; Strengthening the judicial mechanism of environmental duty crime; Strengthening the supervision mechanism of environmental duty crime; Through the improvement of the mechanism of prevention and control of environmental job-related crimes, we should pay attention to both the symptoms and the symptoms, comprehensively manage them, and focus on the formation of environmental supervisors who cannot and dare not. It is necessary to establish and perfect the prevention and control mechanism of environmental job-related crimes in China and reduce the crimes caused by dereliction of duty of environmental supervisors, which will surely reduce the occurrence of environmental crimes.
