辽河流域水污染防治法律问题研究

【摘要】： 辽河位于中国东北地区南部,是我国东北地区南部的最大河流,是中国七大江河之一。辽河流域总面积21.9万平方公里。1996年,国务院把包括辽河在内的“三河三湖”作为国家治理的重点,治理辽河污染虽然取得了一定成效,但是河水污染仍很严重。治理辽河污染是一个浩大的工程,需要走千里路,越万重山。实行水资源的流域管理,已为世界大多数国家所认同,并己成为当前水事立法的普遍趋势。当前,辽河流域水资源严重短缺,用水效率低下,污染严重,辽河流域的水资源管理面临严峻的挑战。开展辽河流域管理立法研究,建立一个完整而系统的水资源流域管理法律体系,是解决辽河流域水资源问题,实现水资源的可持续利用的重要保障。本文采取语义分析、比较分析、历史分析等方法尝试着对辽河流域水资源管理立法作一番初浅的探讨。本文共分四个部分:第一部分是辽河流域管理及其污染防治的现状;第二部分是国外流域管理和流域污染治理的立法模式;第三部分是我国流域管理和流域污染防治的立法及其影响;第四部分是辽河流域水污染防治。通过比较分析研究,如下构建辽河流域水资源管理法律体系: 第一,在《环境保护法》中增加“流域管理”的概念及相关的法律规定;第二,制定《水资源流域管理法》,建立一个新型的水资源流域统一管理体制;第三,对于辽河流域,制定专门的流域管理法规;第四,建立健全相关的流域管理配套法律法规。
[Abstract]:Liaohe River is located in the south of Northeast China. It is the largest river in the south of Northeast China. It is one of the seven major rivers in China. The total area of Liaohe River Basin is 219,000 square kilometers. 1996, The State Council has taken the "three rivers and three lakes", including the Liaohe River, as the focus of national control. Although it has achieved certain results in controlling the pollution of the Liaohe River, the pollution of the river water is still very serious. The treatment of the Liaohe River pollution is a huge project and requires thousands of miles to go. More than ten thousand heavy mountains. The implementation of watershed management of water resources has been recognized by most countries in the world and has become a general trend of current water legislation. At present, water resources in the Liaohe River basin are seriously short of water resources, water use efficiency is low, and pollution is serious. The management of water resources in Liaohe River Basin is faced with severe challenges. It is necessary to carry out the legislative research on the management of Liaohe River Basin and establish a complete and systematic legal system for the management of water resources in Liaohe River Basin. An important guarantee for the sustainable use of water resources. In this paper, semantic analysis, comparative analysis and historical analysis are adopted to try to make a preliminary discussion on the legislation of water resources management in Liaohe River Basin. This paper is divided into four parts: the first part is the current situation of Liaohe River Basin management and pollution control, the second part is the legislative model of foreign watershed management and watershed pollution control. The third part is the legislation and influence of watershed management and pollution control in China, and the 4th part is water pollution control in Liaohe River Basin. Through comparative analysis and research, the legal system of water resources management in Liaohe River Basin is constructed as follows:. First, the concept of "watershed management" and related legal provisions should be added to the "Environmental Protection Law"; second, the "Water Resources Basin Management Law" should be formulated to establish a new unified management system for water resources basins; third, for the Liaohe River basin, Formulate special watershed management laws and regulations; 4th, establish and improve relevant watershed management supporting laws and regulations.
