【摘要】：最近几年,在人口不断增长和经济快速发展的双重压力下,我国农村环境污染问题日益突出,农村环境污染已成为威胁水体、土壤、大气、农产品的重要来源,这不仅破坏了农村生态系统安全,危害农业生态安全,而且通过食品以及水污染源的损害危机广大农村居民的健康状况,同时对农业和农村经济的可持续发展构成了严重的威胁。因此,我们国家最近几年开始重视研究以农村环境污染为主体的农村环境污染问题,并把农村环境污染的防治、监督和治理最为一项基本国策予以贯彻落实,先后制定了多项法律法规以及部门规章制度,从不同角度加强对我国农村环境污染问题的研究和治理,防治我国农村环境污染的法律研究已经成为我国新农村建设首要解决问题之一,也是我国科学发展观的具体体现。从这个角度上来看对我国农村环境污染现状及原因、法律对策的研究都具有十分重要的意义。本论文借助可持续发展理论、代际公平理论等相关理论知识,研究我国农村环境污染的意义、现状问题以及农村环境污染法律制度问题。在对相关理论和方法进行阐述后,进一步分析我国农村环境污染的来源、成因以及现行法律制度方面存在的问题,提出了构建我国农村环境污染的法律制度体系框架及具体法律政策措施。改善农村环境,加大污染的防治力度,必须要建立一个与之相适应的法律体系。本文的重点放在我国农村环境污染防治的法律研究上,主要介绍现行法律体系中,关于我国农村环境污染的规定比较繁杂,并通过对立法层面、执法层面和司法层面的分析和总结,指出取得的成就和不足,强调我国农村环境污染法律制度层面的不完善。初步提出构建完善农村环境保护立法、加强农村环境执法、提高环境违法成本、提高农民的环境维权意识、健全环境司法救济制度和强化农村环境污染综合防治机制体系等六个方面的农村环境污染防治法律完善体系框架。同时,本文的创新点主要是以农村环境污染为研究对象,在介绍我国农村环境污染的现状、种类、危害的前提下,分析我国环境污染成因,通过国外有关农村环境污染治理方面的法律法规,总结我国在环境治理方面的弊端,提出健全我国农村环境污染的设想。并通过对我国部分地区农村环境污染问题进行了详细的调查和深刻的剖析,并指出其环境法制度方面亟待解决的问题,提出解决我国农村环境污染的法律防治对策。农村环境污染问题的解决,关系到社会主义新农村建设“生产发展、生活富裕、乡风文明、村容整洁、管理民主”目标和要求的实现；关系到农村乃至全国经济、社会和环境的协调发展；关系到法律手段与经济科技手段密切配合下的污染防治对策。建立完善的农村环境污染防治法律体系,无疑是上述要求的得以实现的前提,必须加快立法进程,加强执法力度,强化农村环境污染综合防治机制,对相关问题进行规定,使我国农村环境污染的防治有法可依,执法必严,违法必究。
[Abstract]:In recent years , under the double pressure of population growth and rapid economic development , the problem of rural environmental pollution in our country has become more and more serious , and the rural environmental pollution has become an important source of threat to water , soil , atmosphere and agricultural products . Based on the theory of sustainable development and the theory of intergenerational equity , this paper studies the significance , present situation and legal system of rural environmental pollution in our country . After the elaboration of relevant theories and methods , the author further analyzes the source , origin and existing legal system of rural environmental pollution in our country , and puts forward the legal system framework and specific legal policy measures for the construction of our country ' s rural environmental pollution . In this paper , the author points out that China ' s rural environmental pollution is not perfect . At the same time , the author points out that China ' s rural environmental pollution is not perfect . The solution of the environmental pollution in the countryside is related to the realization of the goals and requirements of the new socialist countryside construction , such as the production and development , the living well - off , the township wind civilization , the village capacity , the democratic goal and the demand ; the establishment of a perfect legal system for the prevention and control of environmental pollution in the countryside is undoubtedly the prerequisite for the realization of the above requirements .
