我国流域水污染防治立法问题研究

【摘要】： 良好的流域水环境对一国可持续发展战略的实现,对整个人类的生存和发展都有着深远的影响。随着我国经济的快速发展,我国许多流域都已遭受到严重的污染。面对污染日益严重的流域水环境,国家和地方皆制订了一系列保护流域水环境的法律法规及规章。虽然以上法律法规规章对流域水环境保护做了比较全面的规定,但由于我国流域水污染防治立法理念的陈旧,单纯的追求经济发展,而忽视对流域水环境的保护;同时,我国流域水污染防治立法采取的是各部门分别立法的模式,致使对流域水环境保护的各部法律法规及规章之间存在着一定的冲突,致使我国流域水污染的防治立法存在重大缺陷。因此,采取国际上先进的统一立法模式,立足于流域水污染的流域特性,制定一部专门的《流域水污染防治法》,为我国流域水环境提供全面有效的的法律保护。文章首先对我国流域水污染防治立法现状进行评析。我国制定的有关流域水环境保护的法律虽不少,但是由于存在立法理念陈旧,立法模式落后等原因致使我国流域水污染防治不理想。文章的第二部分是借鉴国外流域水污染防治立法的先进经验,为我国流域水污染防治立法提供借鉴。第三部分是在借鉴国外先进经验的基础上,完善我国《流域水污染防治立法》。首先对制定一部专门的《流域水污染防治法》的必要性进行分析,然后对《流域水污染防治法》的主要内容进行构想。如立法原则,流域水污染防治的主要法律制度等。最后是构建综合性流域管理模式,即建立一个由流域各行政区域通力合作、特定的流域水污染防治机构全权负责、各相关部门配合并权责明确、社会公众广泛参与的流域水污染防治的管理体制。
[Abstract]:A good watershed water environment has a profound impact on the sustainable development strategy of a country and on the survival and development of the whole human being. With the rapid economic development of our country, Many watersheds in China have been seriously polluted. The state and local governments have formulated a series of laws and regulations to protect the water environment of watersheds. Although the above laws and regulations have made relatively comprehensive provisions on the protection of watershed water environment, due to the outmoded concept of legislation on the prevention and control of water pollution in watersheds in China, We simply pursue economic development, but ignore the protection of watershed water environment. At the same time, the legislation of watershed water pollution prevention and control in our country adopts the model of legislation by different departments. As a result, there are some conflicts between laws, regulations and rules of water environmental protection in watersheds, which lead to great defects in the legislation of water pollution prevention and control in watersheds of our country. Therefore, the advanced unified legislation model is adopted in the world. Based on the characteristics of watershed water pollution, a special Watershed Water pollution Prevention and Control Law is formulated to provide comprehensive and effective legal protection for the watershed water environment in China. This paper first analyzes the current situation of the legislation on water pollution prevention and control in watersheds in China. Although there are many laws on the protection of water environment in watersheds in China, due to the outmoded legislative ideas, The second part of this paper is to draw lessons from the advanced experience of foreign watershed water pollution control legislation. The third part is based on the advanced experience of foreign countries. First, the necessity of formulating a special Watershed Water pollution Prevention and Control Law is analyzed, and then the main contents of the Watershed Water pollution Prevention and Control Law are conceived. Finally, the establishment of a comprehensive watershed management model, that is, the establishment of a river basin by the administrative regions of the United Nations, a specific watershed water pollution prevention and control agencies fully responsible, The management system of river basin water pollution prevention and control with the cooperation of relevant departments and clear responsibilities and extensive participation of the public.
