我国生态环境修复基金法律制度研究

【摘要】：改革开放以来,我国步入经济快速上行的新阶段,民众的生活质量得到明显的改观。就在国家大踏步的向实现中华民族伟大复兴和全面建设小康社会的道路上不断前进的同时,伴随GDP快速增长而来的是近些年来频发的生态破坏与环境污染问题。生态环境问题不仅阻碍了我国当前形势下经济与社会的可持续发展,更加严重影响了全体国民的幸福指数。随着环境公益诉讼制度在我国的设立和完善,环境公益诉讼案件也越来越多的出现在司法实践当中。由于生态环境本身所具有的公共产品属性使得涉及环境公益诉讼的案件往往受害者众多或受害者为不特定的社会群体,因此所带来的生态环境修复补偿金大都数额巨大。如何管理、使用生态环境修复补偿金成为了环境法学界新的热点话题。由“天价赔偿金”所引出的生态环境修复基金制度在我国的构建和完善成为了解决此类问题的关键。首先,本文通过从生态环境修复的相关概念入手,辨析生态环境修复与生态环境恢复之间的区别,分析得出生态环境修复更加突出人类在认识和改造世界当中的主观能动性。由此,从生态环境修复的内涵中对其进行整体的了解。其次,通过对生态环境修复基金概念及功能的分析,确立生态环境修复基金对于生态保护、环境治理的重要作用。再次,文章通过对在我国构建和完善生态环境修复基金制度必要性、可行性的分析,在理论层面上,为该制度的构建和完善提供依据。最后,通过对国内外生态环境修复基金具体实践经验教训的总结得出应当在我国构建以专门委员会或全国性基金会形式设立的生态环境修复基金;加之对我国面临的现状及其问题分析,提出了涉及生态环境修复基金法律性质、管理模式以及运营制度等方面的具体构想。
[Abstract]:Since the reform and opening up, China has entered a new stage of rapid upward economic growth, and the quality of life of the people has been obviously improved. While the country is striding forward to the road of realizing the great rejuvenation of the Chinese nation and building a well-off society in an all-round way, Along with the rapid growth of GDP is the frequent ecological destruction and environmental pollution in recent years. The eco-environmental problems not only hinder the sustainable development of economy and society under the current situation of our country. It has seriously affected the happiness index of all citizens. With the establishment and improvement of the environmental public interest litigation system in China, Environmental public interest litigation cases also appear more and more in judicial practice. Due to the ecological environment itself has the property of public goods, cases involving environmental public interest litigation often have many victims or the victims are not specific social groups. As a result, most of the compensation for the restoration of the ecological environment is huge. How to manage it? The use of compensation for ecological environment restoration has become a new hot topic in the field of environmental law. The construction and perfection of the ecological environment restoration fund system derived from "sky-high compensation" has become the key to solve this kind of problems. By analyzing the difference between the restoration of ecological environment and the restoration of ecological environment, this paper analyzes the difference between the restoration of ecological environment and the restoration of ecological environment, and concludes that the restoration of ecological environment highlights the subjective initiative of human beings in the process of understanding and transforming the world. Secondly, through the analysis of the concept and function of the ecological environment restoration fund, the important role of the ecological environment restoration fund for ecological protection and environmental governance is established. Through the analysis of the necessity and feasibility of constructing and perfecting the ecological environment restoration fund system in our country, the paper provides the basis for the construction and perfection of the system on the theoretical level. By summing up the practical experience and lessons of the domestic and foreign ecological environment restoration fund, it is concluded that the ecological environment restoration fund should be set up in our country in the form of special committee or national foundation. In addition, based on the analysis of the current situation and its problems in China, the author puts forward some concrete ideas concerning the legal nature, management mode and operation system of the ecological environment restoration fund.
