银行扶持企业发展低碳经济法律制度研究

【摘要】：法律活动是具有目的性的社会实践活动。研究银行扶持企业发展低碳经济法律制度不仅可以指引立法,还可以指导法律实践,指明学术研究的方向。随着经济发展与资源环境之间的矛盾日益加剧,发展低碳经济不光是应对气候变化的客观需要,还是可持续发展的内在要求。过去,人们总把对环境的保护的目光侧重于初级产品的制造业和生产部门。如今,人们终于认识到金融服务业才是实现可持续发展的关键环节。银行及其他金融机构有能力把资源引向环境表现良好的项目或企业。银行及其他金融机构为重大项目或企业提供资金支持时,有责任评估、监督该项目或企业对环境及社会的影响。截止到目前,国内尚无专门研究银行扶持企业发展低碳经济法律制度的学术著作问世。然而在国外,对银行扶持企业发展低碳经济法律制度早已进行过深入探究,国内却很少引进。我国国内外现实显示出我国银行扶持企业发展低碳经济的迫切性,同时也反映了我国银行扶持企业发展低碳经济将面临诸多挑战,加快完善银行扶持企业发展低碳经济相关法律政策,建立有利于低碳经济发展的法律体系是不可或缺的。本文从银行扶持企业发展低碳经济的角度,分析了完善银行扶持企业发展低碳经济法律制度的原因,借鉴国外银行在扶持企业发展低碳经济的成功经验,从构建低碳信贷法律制度、建立银行扶持低碳经济企业的激励机制、建立银行扶持低碳经济企业的监督法律制度等方面提出设想,以推动低碳经济在中国的发展。
[Abstract]:Legal activity is a purposeful social practice. Research on the legal system of supporting enterprises to develop low-carbon economy can not only guide legislation, but also guide legal practice. Pointing out the direction of academic research. With the increasing contradiction between economic development and resources and environment, developing a low-carbon economy is not only an objective need to cope with climate change, but also an inherent requirement of sustainable development. Environmental protection has always been focused on the manufacturing and production sectors of primary products. Banks and other financial institutions have the ability to channel resources to environmentally sound projects or enterprises. Banks and other financial institutions are important. When a project or enterprise provides financial support, Be responsible for assessing and monitoring the environmental and social impact of the project or enterprise. Up to now, there is no academic work on the legal system of banks supporting enterprises to develop low carbon economy. However, in foreign countries, the legal system of banks supporting enterprises to develop low carbon economy has been deeply explored for a long time. In China, however, it is seldom introduced. The reality at home and abroad of our country shows the urgency of supporting enterprises to develop low-carbon economy in our country, and it also reflects that the banks of our country will face many challenges to support enterprises to develop low-carbon economy. It is indispensable to speed up and perfect the legal policies related to the development of low carbon economy and to establish a legal system conducive to the development of low carbon economy. From the point of view of bank supporting enterprises to develop low carbon economy, this paper analyzes the reasons for perfecting the legal system of banks supporting enterprises to develop low carbon economy, and draws lessons from the successful experience of foreign banks in supporting enterprises to develop low carbon economy. In order to promote the development of low-carbon economy in China, this paper puts forward some tentative ideas from the aspects of constructing the legal system of low-carbon credit, establishing the incentive mechanism for banks to support low-carbon economic enterprises, and establishing the supervision legal system of banks to support low-carbon economic enterprises, in order to promote the development of low-carbon economy in China.
