电力监管法制化问题研究

【摘要】：行政法是调整政府行政活动的部门法,主要从公共行政的组织、行为、程序和救济等方面入手,研究法治国家下依法行政的问题。随着我国对公用事业监管的日益升温,电力监管作为公共行政领域的重要问题,将其纳入行政法学的研究范围既有现实意义又有理论价值。电力监管是我国政府对公用事业监管中的一个重要部分,随着电力市场的逐步完善和市场功能的发挥,电力监管机构目标与职能也日益丰富化和明朗化。政府应当通过放松竞争环节的经济性监管,加强自然垄断环节的网络接入监管,来确保电力市场的公平和有序竞争。我国电力监管的法制化进程还存在很多不科学的地方,与世界发达国家相比有一定差距。20世纪90年代以来,英美等经济发达国家对电力行业进行了法律监管制度的变革,促进了法律监管理论与电力监管实践的结合。尽管英美两国的电力体制市场化改革演变路径不同,但有一些共同的经验值得我们借鉴,如：法律制度确保监管机构的独立性；重视电力监管法制基础的完善；以及注重监管方式的变革等。完善的法律法规是电力监管机构实施有效监管的前提和基础,也是我国电力市场化改革顺利进行的重要保证。在我国电力监管法制化进程中,电力监管机构与电力监管法律基础建设刚刚起步,不仅许多问题亟待研究解决,而且没有成熟的经验和适合我国自身的完善的政府规制理论可循。因此,在电力改革的实质性阶段,政府如何正确地行使宏观监管职能、规范市场主体和监管主体的行为、科学地运用电力监管法律手段促进电力产业的发展,正成为我国电力监管法制化研究的全新课题。
[Abstract]:The administrative law is the departmental law regulating the administrative activities of the government , mainly from the aspects of the organization , behavior , procedure and relief of public administration , and studies the problem of administration according to law in the country under the rule of law . With the increasing temperature of the supervision of public utilities , the supervision of electric power is an important issue in the field of public administration . It is of practical significance and theoretical value to integrate it into the scope of administrative law . Electricity supervision is an important part of our government ' s supervision of public utilities . With the gradual improvement of the power market and the function of the market , the objectives and functions of the power supervision institutions are becoming more and more abundant . The government should strengthen the supervision of the economy of the competition link , strengthen the network access supervision of the natural monopoly links , and ensure the fair and orderly competition of the power market . There are many unscientific places in the legal process of power supervision in China . Since the 1990s , Anglo - American and other developed countries have carried out the reform of the legal supervision system in the power industry , promoted the combination of the theory of legal supervision and the practice of power supervision . The perfection of laws and regulations is the precondition and foundation for the effective supervision of the power supervision institutions , and also the important guarantee of the smooth progress of the reform of the electric power market . In the process of the legalization of power supervision in China , not only many problems need to be solved , but not only many problems need to be solved , but there is no mature experience and perfect government regulation theory . Therefore , in the substantive stage of power reform , how the government exercises the macro - regulation function correctly , regulates the behavior of the market subject and the supervision subject , scientifically applies the legal means of power supervision to promote the development of the power industry , and is becoming a new subject in the legal research of power supervision in China .
