行政法视野下水环境保护问题研究

【摘要】：当今我国水环境保护问题越来越受到重视,各个领域的学者都进行了一些探讨,本文从行政法学的角度,着重分析了在水环境保护立法中和实践中涉及政府责任的问题,试图通过解决这些问题来达到保护水环境的目的。本文共分为四个部分,主要内容如下：第一部分概述了行政法视野下水环境保护的基本问题。其一,界定了水环境保护的概念体系,厘清水体、水资源、水污染、水生态、水安全与水环境相关概念之间的联系和区别,概括出水环境保护的内涵,其二,弄清在行政法视野下,解决水环境保护问题的两个维度,即水环境保护立法层面以及水环境保护实践层面。第二部分从水环境保护的立法层面进行分析,首先,对美、德、日三国的水环境保护立法状况予以综述,进而总结国内水环境立法现状和问题,其次,主要以《合肥市水环境保护条例》为例,对水环境保护的立法进行了实证研究。最后,提出我国水环境保护立法应有的立法理念。第三部分从水环境保护的实践层面进行分析,阐述了水环境保护中的政府责任问题。首先,界定了水环境保护中的政府责任,其次,归纳了水环境保护中政府责任的形式,包括水资源开发与利用、水污染防治、水生态安全这三个环节政府责任具体的体现形式,最后,分析了政府责任在水环境保护领域中存在的问题。第四部分提出了我国水环境保护问题的解决路径。从水环境保护立法方面和水环境保护政府责任方面加以完善,完善水环境保护立法主要包括提高水环境保护地方立法水平和建立健全水环境立法质量评价机制,完善水环境保护的政府责任主要包括构建水环境保护立法中政府责任机制,具体包括明确问责主体、问责对象、问责条件等,注重经济手段的运用,引入公众参与、发挥非政府组织的作用,建立公民环境权利和救济制度。
[Abstract]:Nowadays , the problem of water environmental protection in China has been paid more and more attention , and scholars in various fields have carried out some discussion . In this paper , from the angle of administrative law , the paper analyzes the problem of government responsibility in the legislation of water environmental protection , and tries to achieve the aim of protecting the water environment by solving these problems . The article is divided into four parts , the main contents are as follows : The first part summarizes the basic problems of water environmental protection in the field of administrative law . Firstly , the concept system of water environmental protection is defined , and the relation between water , water resources , water pollution , water ecology , water safety and water environment is defined . The second part analyzes the legislative level of water environmental protection , firstly , summarizes the legislative situation of water environmental protection in the three countries of America , Germany and Japan , then summarizes the current situation and problems of domestic water environment legislation , and secondly , carries on an empirical study on legislation of water environmental protection in the water environment protection regulation of Hefei . Finally , the legislative idea of water environmental protection legislation in China is put forward . The third part analyzes the government responsibility in water environment protection from the practical level of water environmental protection . First , it defines the government responsibility in water environmental protection . Secondly , it summarizes the forms of government responsibility in water environmental protection , including the specific embodiment of government responsibility in the three links of water resource development and utilization , water pollution prevention and water ecological security . Finally , the problems existing in the field of water environmental protection are analyzed . The fourth part puts forward the way to solve the problem of water environmental protection in China . The legislation of water environmental protection and the responsibility of water environmental protection government are perfected . The legislation of perfecting water environmental protection mainly includes the improvement of the local legislation level of water environmental protection and the establishment of the legislation quality evaluation mechanism of water environment . The government responsibility for improving the water environmental protection mainly includes the construction of the government responsibility mechanism in the legislation of water environmental protection , including the explicit accountability subject , the accountability object , the accountability condition , etc . , the application of economic means , the introduction of public participation , the role of non - governmental organizations , the establishment of the citizen environment rights and the relief system .
