我国风力发电法律促进机制研究

【摘要】： 发展风电是我国保障能源安全、应对全球气候变化、保护环境的重要举措。近年来,在相关政策法规的激励下,我国的风电发展取得了可喜的成绩,特别是2005年《可再生能源法》的颁布极大地促进了我国风电的发展。与我国风电产业快速发展相对应的是对风电发展相关法律问题的研究也日益深入,且已经出现了一大批重要理论成果。目前相关的研究主要集中在以下方面:一是从可再生能源法制整体的角度,对风电法制建设做出顺带的探讨;二是从比较法的角度,借鉴丹麦、德国等风电较发达国家的成熟经验,对我国的风电法制建设提出建议;三是就促进风电发展的具体法律机制进行深入研究。在上述三个方面的研究中,第一、二方面的研究较多也较为深入,而第三方面的研究则较少有人涉及。本文即试图弥补这方面的不足,通过对我国风电法律促进机制较全面、系统的梳理和分析,在借鉴国外成熟经验的基础上,构建能够促进风电持续、健康发展的具有中国特色的法律机制体系。这也是本文选题的价值所在和写作目的。总体上,全文分三部分: 第一部分,“风力发电的概论”。本章首先对风能及其特点进行简要的概述,然后介绍了我国风力发电发展的现状及其前景,并进一步探讨了促进我国风电快速发展的必要性和时代意义; 第二部分,“我国促进风电发展的立法现状及主要法律机制分析”。本章在简要介绍我国促进风电发展的立法现状之后,对我国促进风电发展的的主要法律机制进行系统的概括和梳理,并对其中存在的不足和原因进行着重分析。第三部分,“完善我国风电法律促进机制的思考”。针对现有促进机制的不足,提出进一步完善我国风电法律促进机制的建议:完善以总量目标制度为核心,以全额保障性收购制度、固定电价制度、费用补偿制度等为主体的制度体系,改革现有的电价定价制度明确确立固定电价制度、完善现有的费用分摊制度、进一步完善以财政贴息贷款和税收减免为主的财税支持体系等。
[Abstract]:Wind power development is an important measure to ensure energy security, cope with global climate change and protect the environment in China. In recent years, with the encouragement of relevant policies and regulations, China's wind power development has made gratifying achievements. Especially, the promulgation of the Renewable Energy Law in 2005 has greatly promoted the development of wind power in China. And a large number of important theoretical achievements have emerged. At present, the relevant studies are mainly focused on the following aspects: first, from the perspective of the legal system of renewable energy, to make a by-pass discussion on the construction of the wind power legal system; and second, from the perspective of comparative law, Drawing on the mature experience of more developed countries such as Denmark and Germany, this paper puts forward some suggestions on the construction of wind power legal system in China. Thirdly, it makes an in-depth study on the specific legal mechanism to promote the development of wind power. In the above three aspects of the research, first, Two aspects of the study are more in-depth, while the third aspect of the study is less involved. This paper attempts to make up for the deficiencies in this area, through a more comprehensive and systematic analysis of the legal promotion mechanism of wind power in China. Based on the mature experience of foreign countries, this paper constructs a legal system with Chinese characteristics which can promote the sustained and healthy development of wind power, which is also the value of this topic and the purpose of writing. In general, the thesis is divided into three parts:. The first part, "introduction to wind power generation". This chapter first gives a brief overview of wind energy and its characteristics, and then introduces the current situation and prospects of wind power generation in China. The necessity and significance of promoting the rapid development of wind power in China are also discussed. The second part, "Analysis of the current legislation and main legal mechanism of promoting wind power development in China". This chapter briefly introduces the current legislative situation of promoting wind power development in China. The main legal mechanism to promote the development of wind power in China is systematically summarized and combed, and the shortcomings and reasons are analyzed emphatically. The third part, "thinking of perfecting the legal promotion mechanism of wind power in our country". In view of the deficiency of the existing promotion mechanism, the paper puts forward some suggestions for further perfecting the legal promotion mechanism of wind power in China: perfecting the system of total quantity target as the core, The system system, which is based on the full guarantee purchase system, the fixed electricity price system, the cost compensation system and so on, reforms the existing electricity price pricing system to establish the fixed electricity price system and to perfect the existing cost sharing system. We will further improve the fiscal and tax support system, which is based on financial discounted loans and tax deductions.
