【摘要】： 农村社会福利是提升农村居民物质文化生活水平的有力保障。作为社会保障制度的“最高层次”,其在我国却由于社会福利概念的定位模糊以及城乡二元化体制差异下的制度安排缺位等原因而停滞不前。随着我国“社会主义新农村建设”战略任务的推进,农村社会福利成为最受人民关注的“新农村”建设着力点。因此,我们必须尽快明晰农村社会福利制度在社会保障体系中的层次定位以及内涵与外延,关注其制度中所存在的各项问题,加紧对农村社会福利制度具体内容的构建和完善。本文试从五个部分对于我国农村社会福利相关法律问题进行探讨,希冀于能够拨开理论迷雾,切实找到构建我国农村社会福利制度的有效途径。第一部分,我国农村社会福利制度的概述。本部分从理论上探讨社会福利定义以及我国农村社会福利的内涵与外延,明晰论文之基础——即法律意义上的适于我国国情的发展型社会福利概念。并通过对于我国农村社会福利的历史以及意义探究,追本溯源于该项制度之于我国保障体系的重要地位。第二部分,域外农村社会福利制度的比较与启示。在本部分中以不同的福利制度为区分,选取英国、瑞典的大福利制度,美国、日本的特殊福利制度,以及具有更大相似性的发展中国家印度的福利制度为对象,通过对于其农村社会福利领域的专门性探讨,得到具有重要意义的实质性启发。第三部分,我国农村社会福利制度现状及问题的分析。本部分通过探究我国农村社会福利制度的现状,着重分析了该制度现状下所反映出的错杂问题。其不仅是政府和社会的认识不足、农村社会福利体系的不甚健全,亦存在着严重的制度缺位。第四部分,我国农村社会福利制度的宏观设想。在这一部分中,着重从宏观层面上阐述我国农村社会福利制度的相关理论。从制度定位的明确到基本目标的确立,再到基本原则的探讨,力求能够为之后的具体制度构建打下较好的基础。第五部分,我国农村社会福利制度构建的具体设想。此一部分为本文的结尾部分,亦是本文的重中之重。通过对于资金保障机制、主要建设方向、制度保障机制以及督促机制的细致探讨和尝试性构建,勾画出我国农村社会福利制度的具体构成,并提出了作者对于该项制度的自有见解,以期能够抛砖引玉。
[Abstract]:Rural social welfare is an effective guarantee to improve the material and cultural living standard of rural residents. As the "highest level" of social security system, it is in our country due to the vague orientation of the concept of social welfare and the poor urban-rural dual system. With the development of the strategic task of "building a new socialist countryside" in China, Rural social welfare has become the focus of the construction of "new countryside". Therefore, we must make clear as soon as possible the level orientation, connotation and extension of rural social welfare system in the social security system. Pay attention to the problems existing in the rural social welfare system, accelerate the construction and perfection of the specific contents of the rural social welfare system. This paper tries to discuss the relevant legal problems of rural social welfare in China from five parts. It is hoped that we can get rid of the fog of theory and find an effective way to construct our country's rural social welfare system. The first part is an overview of China's rural social welfare system. This part theoretically discusses the definition of social welfare and the connotation and extension of rural social welfare in China. Clarify the foundation of the thesis-that is, the concept of developmental social welfare in the sense of law suitable for the national conditions of our country, and explore the history and significance of social welfare in rural areas of our country through the study of the history and significance of social welfare in rural areas. Trace back to the important position of this system in our country's security system. The second part, the comparison and enlightenment of the extra-territorial rural social welfare system. In this part, with different welfare systems as the distinction, select the Great Britain, Sweden welfare system, the United States, Japan's special welfare system, And the welfare system of India, which is similar to other developing countries, has been studied in the field of rural social welfare, which is of great significance. The third part, the analysis of the present situation and problems of the rural social welfare system in China. This paper mainly analyzes the problems reflected in the present situation of the system, which is not only the lack of understanding of the government and the society, the rural social welfare system is not perfect, but also there is a serious lack of the system. Part 4th, the macro assumption of the rural social welfare system in China. In this part, the relevant theories of the rural social welfare system in our country are expounded from the macro level, from the clear orientation of the system to the establishment of the basic goal. Further to the discussion of basic principles, we try to lay a good foundation for the later concrete system construction. This part is the last part of this paper, which is also the most important part of this paper. Through the fund guarantee mechanism, the main construction direction, The detailed discussion and tentative construction of the system guarantee mechanism and the supervision mechanism outline the concrete constitution of the rural social welfare system of our country and put forward the author's own opinions on the system in order to be able to offer some valuable ideas.
