碳排放权交易的法律制度构建

【摘要】：环境问题和环境危机是在人的无节制的追求高层次的物质生活条件下产生的，对环境的无序攫取造成了对化石能源的过渡依赖和气候变化的产生，，传统的环境保护手段显示出了在应对新的环境问题上的缺陷，作为利用市场机制解决环境问题的新手段，碳排放权交易制度日益受到重视。碳排放权交易制度利用市场配置资源最优的功能，在发挥企业积极性的条件下，很好的解决了环境资源生态价值主体缺失的症结，实现经济发展效率和环境保护力度的和谐统一，是一种应对气候变化和解决环境问题的新方式。任何一项法律制度的建构和运行都离不开对客观规律的共性研究和对个体特征的深刻认识，碳排放权交易法律制度作为减缓和应对气候变化的国际共识，在实际的实践探索中应该具有多样性，应该允许各个碳排放权交易法律制度呈现出不同的特色，这些既有共性特征又有各自特色的碳排放权交易法律制度既是对碳排放权交易法律关系的调整手段，也是动态碳排放权交易法律关系在静态法律制度中的一种体现。本文通过对碳排放权属性的界定和碳排放权交易理论基础的梳理，在借鉴国际社会碳排放权交易的成功经验上，归纳了制约我国碳排放权交易发展的法律困境，提出通过法律规制、市场整合、管理集约、金融创新等多个方面来构建适合我国国情的碳排放权交易法律制度，希图通过系统的论述来加强对碳排放权交易法律制度的理论探讨和决策支持。
[Abstract]:The environmental problems and the environmental crisis is produced in people's unrestrained pursuit of material life conditions under high level, the environmental disorder caused a grab for fossil energy dependence and climate change, environmental protection, the traditional means of showing in response to new environmental problems on the issue of defects, as a new way the use of market mechanisms to solve environmental problems, carbon emissions trading system has attracted more and more attention.
Carbon emissions trading system by using the optimal resource allocation function of the market, play the enthusiasm of enterprises under the condition of a good solution to the lack of ecological value of the main crux of the problem, to realize the harmonious unity and efficiency of economic development and environmental protection efforts, it is a new way of tackling climate change and solve environmental problems.
Construction and operation of any legal system all cannot do without common research on objective law and a profound understanding of individual characteristics, carbon emissions trading legal system as an international consensus on mitigation and response to climate change, in the actual practice should have diversity, should allow all carbon emissions trading legal system show different characteristics, which both have common characteristics and respective characteristics of carbon emissions trading legal system is not only the means to adjust carbon emissions trading legal relationship, but also a reflection of the dynamic carbon emissions trading legal relationship in the static in the legal system.
Based on the definition of the properties of carbon emissions and carbon emissions trading theory carding, drawing lessons from the international community in carbon emissions trading, which summarizes the legal dilemma of China's carbon emissions trading development, put forward the legal regulation, market integration, intensive management, many aspects of financial innovation to build our country's carbon emissions trading legal system, through the system to discuss to strengthen support for carbon emissions trading legal system theory discussion and decision.
