矿产资源生态补偿法律机制研究

【摘要】：矿产资源是人类赖以生存和发展的重要物质基础,矿产资源的开采业是我国国民经济和社会发展的基础性产业。但是,由于我国矿产资源开采业的技术水平和设备有限,再加上利益的驱使,使得在矿产资源的开采过程中造成了许多资源上的浪费和环境的污染。从当前的经济形势来看,在今后相当长一段时期内,我国的经济将会出现高速发展的势头,那么必然会加大对矿产资源的需求量,如果在矿产资源开发的过程中一再地对资源和生态环境造成破坏的话,将会很难实现资源的可持续利用以及环境与社会的可持续发展。因此,我们必须下大力量对因矿产资源的开采而造成的生态环境破坏给予适当的补偿。本文首先对矿产资源和生态补偿的基本概念和理念进行概述,然后依据劳动价值理论、矿山地租理论、资源耗竭补偿理论以及外部性理论就我国目前在矿产资源生态补偿制度中存在的法律问题进行详细的分析。最后,借鉴国外先进经验再结合我国矿产资源生态补偿法律制度现状提出了切实可行的应对之策,从立法上寻找突破口,为其实施提供法制保障。
[Abstract]:Mineral resources are an important material basis for human survival and development, mineral resources exploitation is the basis of China's national economic and social development of the industry. However, due to the mining of mineral resources, the level of technology and Equipment Co., together with interest driven, which caused a lot of waste of resources and environment the pollution in the process of the exploitation of mineral resources. Judging from the current economic situation, in the future for a long period of time, China's economy will appear in the momentum of rapid development, it will inevitably increase the demand for mineral resources, if in the process of mineral resource exploitation repeatedly on resources and ecological environment caused by destruction, sustainable development will be difficult to achieve sustainable use of resources and the environment and society. Therefore, we must make great effort on the ecological environment caused by the exploitation of mineral resources Damage is given appropriate compensation.
Firstly, the basic concepts and ideas of mineral resources and ecological compensation are summarized, and then based on the theory of labor value, resource depletion mine rent theory, compensation theory and externality theory on Legal Problems of mineral resources ecological compensation system in detail. Finally, combined with advanced experience of China's mineral resources ecological compensation legal system put forward practical countermeasures, find a breakthrough from the legislation, to provide legal protection for their implementation.
