生态环境损害赔偿法律制度研究

【摘要】：生态环境损害和传统的环境侵权不一样,在产生因素、危害过程、表现形式、危害结果等方面都有自己的特点,是一种新型损害,属于对生态领域的环境损害。生态领域的环境损害比传统领域的环境侵权纠纷涉及的问题更复杂棘手,属于新生事物,需要打破旧法律思维的局限,用新视角来看待。从中国当今生态环境的实际情况来看,主要问题表现在:生态环境损害赔偿立法方面的缺陷和相关救济制度的缺失,使生态环境得不到及时有效的修复和保护,严重威胁到人民群众的生命财产安全。因此非常有必要对生态环境损害赔偿法律制度进行逐步完善。在展开构建方面,通过实证梳理和研究,找出我国生态环境损害赔偿法律制度的不足,再以欧盟、日本等经济发达国家相对成熟先进的生态环境损害赔偿制度为基础,借鉴适合我国生态环境损害赔偿发展的部分,即通过加强生态环境损害赔偿方面的立法,完善生态环境损害社会化赔偿机制和多元化纠纷解决机制,在全国范围内初步构建全面成熟的生态环境损害赔偿法律制度,为更好的解决生态领域中的环境损害赔偿问题提供法律制度上的保障,使生态环境损害赔偿“有法可依、有章可循”,顺利有序的开展生态领域的环境损害工作,及时有效修复受损害的生态环境并预防环境受损,恢复生态系统的良性循环,努力营造“青山绿水”的生态环境。
[Abstract]:Ecological environmental damage is different from traditional environmental tort. It is a new type of damage because it has its own characteristics in the aspects of producing factors, harm process, manifestation, harm result and so on. The environmental damage in the ecological field is more complicated and intractable than the problems involved in the environmental tort dispute in the traditional field, and it belongs to the new thing and needs to break the limitation of the old legal thinking. Look at it from a new angle of view. From the actual situation of China's ecological environment today, the main problems are: the defects in the legislation of ecological environment damage compensation and the lack of relevant relief system, The ecological environment can not be repaired and protected in a timely and effective manner, which seriously threatens the life and property safety of the people. Therefore, it is very necessary to gradually improve the legal system of compensation for ecological environment damage. Through empirical analysis and research, we find out the deficiency of the legal system of ecological environment damage compensation in China, and then base on the relatively mature and advanced ecological environment damage compensation system in the developed countries such as the European Union and Japan. Drawing lessons from the part suitable for the development of ecological environment damage compensation in our country, that is, by strengthening the legislation on ecological environment damage compensation, perfecting the socialized compensation mechanism of ecological environment damage and the pluralistic dispute resolution mechanism. A comprehensive and mature legal system for the compensation of ecological environment damage is preliminarily constructed in the whole country to provide a legal system for better solving the problem of compensation for environmental damage in the ecological field, so that the compensation for ecological environment damage can be compensated according to the law. "there are rules to follow," the smooth and orderly development of the ecological field of environmental damage work, timely and effective repair of the damaged ecological environment and prevent environmental damage, restore the virtuous cycle of the ecosystem, and strive to create "green mountains and rivers" ecological environment.
