论我国招商引资项目环境问诊制度的构建

【摘要】:招商引资所带来的环境问题越来越严重,有必要制度相关的制度来引导招商引资过程中对环境问题的处理。本文以我国招商引资项目环境问诊制度为研究对象。文章主要分为三大部分。 第一部主要论述建立我国招商引资项目环境问诊制度的必要性,主要以理论结合实际的方面,从环境保护的历史潮流和发展趋势、经济发展与环境保护的关系、环境壁垒对我国经济发展的影响和国内外现行环保法规的相关规定四个方面来论述的。可持续发展和环保运动催生了绿色消费理念的诞生,传统的经济增长方式的弊端催生了低碳经济的兴起和清洁生产,新型的绿色贸易壁垒和污染产业的转移要求招商引资过程中要考虑环境因素。国内外环境法规彰显了招商引资环境问诊的必要性。 第二部分从法律层面和社会层面两个方面来论述了构建我国招商引资项目环境问诊制度的可行性,以我国环境法体系为基调,结合我国有关中央环保政策及文件来加以论述。任何一项法律制度的建立都必须要有充分的法律依据,招商引资项目环境问诊制度也不例外。以环境法统领的环境保护法律体系为环境项目问诊制度提供了充分的法律依据。强大的经济支撑、成熟的思想体系和丰富的社会实践为招商引资项目环境问诊制度提供了坚实的社会基础。 第三部分主要是我国招商引资项目环境问诊制度的构建,也是分文的核心部分。论述了我国招商引资项目环境问诊制度的主体及其产生的程序、环境问诊的范围、问诊制度的运行模式和表决程序。 在文章的结论部分对论文的研究加以概括和总结。建立符合我国国情的招商引资项目环境问诊制度有利于我国经济增长方式的转变,有利于从源头上截断污染源,改变“以污染换发展”的经济发展模式,实现经济的可持续发展;有利于杜绝发达国家转嫁污染,,维护我国的环境安全;有利于我国产业结构优化升级,大力发展绿色产业,提高产品的市场竞争力;有利于建立我国公平公正的绿色防线,逐步提高我国的环境准要求,维护国内生态环境和人民健康,维护企业的合法利益。
[Abstract]:The environmental problems brought about by attracting investment are becoming more and more serious. It is necessary to introduce relevant systems to guide the treatment of environmental problems in the process of attracting investment. This paper focuses on the environmental inquiry system of investment attracting projects in China. The article is divided into three parts. The first part mainly discusses the necessity of establishing the environmental consultation system of attracting investment projects in China, mainly from the historical trend and development trend of environmental protection, the relationship between economic development and environmental protection. The impact of environmental barriers on the economic development of our country and the relevant provisions of current environmental protection laws and regulations at home and abroad are discussed in four aspects. Sustainable development and environmental movement have spawned the birth of the concept of green consumption. The drawbacks of the traditional economic growth mode have led to the rise of a low-carbon economy and cleaner production. The new green trade barriers and the transfer of pollution industries require the consideration of environmental factors in the process of attracting investment, and the environmental laws and regulations at home and abroad highlight the necessity of environmental consultation. The second part discusses the feasibility of constructing the environmental consultation system of attracting investment projects in China from two aspects: legal level and social level, taking the environmental law system of our country as the keynote. In combination with the relevant central environmental protection policies and documents of our country, any legal system must be established on a sufficient legal basis. The environmental consultation system of investment promotion projects is no exception. The environmental protection legal system led by environmental law provides sufficient legal basis and strong economic support for environmental project consultation system. Mature ideological system and rich social practice provide a solid social foundation for the environmental consultation system of attracting investment projects. The third part is mainly about the construction of environmental inquiry system of attracting investment projects in our country, and also the core part of the paper. It discusses the main body and procedure of environmental inquiry system of attracting investment projects in our country, and the scope of environmental inquiry system. The operating mode and voting procedure of the inquiry system. In the conclusion part of this paper, the author generalizes and summarizes the research of the thesis. The establishment of the environmental inquiry system of attracting investment projects in accordance with the national conditions of our country is conducive to the transformation of the economic growth mode of our country and the cutting off of the pollution sources at the source. Changing the "pollution-for-development" mode of economic development to achieve sustainable economic development; helping to eliminate the transfer of pollution from developed countries and safeguarding our country's environmental security; conducive to the optimization and upgrading of China's industrial structure; and vigorously developing green industries. Improving the market competitiveness of the products is conducive to the establishment of a fair and just green line of defense, gradually raising the environmental requirements of our country, safeguarding the domestic ecological environment and the health of the people, and safeguarding the legitimate interests of the enterprises.
