我国节能法规改进研究

【摘要】：为了改善人类的生存环境,实现人与自然的和谐统一,世界各国均节能降耗和开发利用新能源的节能战略作为解决能源问题的重要举措,中国并不是一个能源富裕的国家,节能降耗至关重要。而节能法规是用来规范整全社会节能活动的依据,我国目前实施的节能法规自实施以来,在取得了一些成绩的同时,但面对的是更为严峻的能源消费形势以及能源状况与我国经济发展阶段之间不可调和的矛盾,故需要不断完善、改进。本文研究内容主要包括:第一部分介绍当前的能源利用形势,第二部分是引入制度变迁理论,分析制度变迁的路径及影响因素,第三部分是总结西方国家在节能法规改进方面的做法,作为我国节能法规改进的借鉴,第四部分是我国节能法规改进的历史历程,第五部分是目前我国节能法规中存在的问题:不适应市场经济的发展要求、对新能源的支持可操作性不强、节能管理体制不明确等,第六部分是从制度变迁的角度提出建议,包括选择引入市场化的节能新机制、完善对新能源的支持方法,健全节能管理体制等内容。本文的创新点在于将制度变迁理论引入对节能法规制度变迁的研究中,分析研究中国节能法规在其变迁过程中的变化,提炼并梳理出推动其变化的各类相关因素来支撑整个框架,力图利用这个新的研究框架更加全面、细致地分析中国节能法规改进。构建一个新的研究框架对中国节能法规改进进行分析是本文的研究目标。但是,限于笔者的学术水平,本文的分析还有失完整,框架的构建和对节能法规改进的分析还有很多不足,只能在以后的学习和研究中予以解决。
[Abstract]:In order to improve the living environment of human beings and realize the harmony and unity between man and nature, all countries in the world save energy and reduce consumption and develop and utilize new energy conservation strategies as an important measure to solve the energy problem. China is not an energy-rich country. Energy saving and consumption reduction are very important. Energy conservation laws and regulations are the basis for standardizing energy conservation activities in the whole society. Since the implementation of energy conservation laws and regulations in our country, some achievements have been made at the same time. But facing the more severe energy consumption situation and the irreconcilable contradiction between the energy situation and the stage of our country's economic development, we need to improve constantly. The main contents of this paper are as follows: the first part introduces the current situation of energy utilization, the second part introduces the theory of institutional change, analyzes the path of institutional change and its influencing factors. The third part is to summarize the western countries in the energy conservation laws and regulations improvement practices, as our country energy conservation laws and regulations to improve the reference, 4th part is our country energy conservation laws and regulations improvement history, Part 5th is the problem in the current energy conservation laws and regulations of our country: it is not suitable for the development of the market economy, the support to new energy is not feasible, the management system of energy saving is not clear, and part 6th is to put forward some suggestions from the angle of institutional change. It includes introducing the new mechanism of market economy, perfecting the supporting method of new energy, and perfecting the management system of energy saving. The innovation of this paper is to introduce the theory of institutional change into the study of the institutional changes of energy conservation laws and regulations, and analyze the changes in the process of the changes of the laws and regulations of energy conservation in China. Abstract and sort out all kinds of relevant factors to support the whole framework, try to use this new research framework more comprehensive, detailed analysis of the improvement of energy conservation laws in China. The purpose of this paper is to construct a new research framework to analyze the improvement of China's energy-saving laws and regulations. However, limited to the academic level of the author, the analysis of this paper is incomplete. The construction of the framework and the analysis of the improvement of energy conservation regulations have many shortcomings, which can only be solved in the future study and research.
