我国防治外来物种入侵立法研究

【摘要】： 生物多样性是人类赖以生存和发展的物质基础,目前世界范围内生物多样性正在遭受严重的破坏。外来物种入侵是严重威胁生物多样性的因素之一。外来物种入侵是指生物物种由原产地通过自然或人为的途径迁移到新的生态环境的过程。外来物种入侵破坏了生物多样性,造成物种单一化,最终导致生态系统的稳定性受到破坏。目前我国在防治外来物种入侵方面的立法还不完善,存在诸多问题,如：立法指导思想和立法宗旨存在缺陷；法律防治体系不完整且法律调整范围相对狭小；相关法律制度不健全等。针对我国防治外来物种入侵法律制度的不足,本文提出几点立法建议,以期对我国防治外来物种入侵立法的完善能够有所帮助。
[Abstract]:Biodiversity is the material basis for human survival and development, At present, biodiversity is being seriously damaged worldwide. Alien species invasion is one of the factors that seriously threaten biodiversity. Alien species invasion refers to the origin of biological species through natural or man-made channels. The process of migration to a new ecological environment. Invasive alien species destroy biodiversity, At present, the legislation on the prevention and control of alien species invasion in China is not perfect, there are many problems, such as: legislative guidelines and legislative purposes are defective; The legal control system is incomplete and the scope of legal adjustment is relatively narrow; the relevant legal system is not perfect and so on. In view of the insufficiency of the legal system of prevention and control of alien species invasion in China, this paper puts forward some legislative suggestions. In order to prevent and control alien species invasion legislation can be helpful.
