我国环境纠纷仲裁制度研究

【摘要】:随着公民环境意识的觉醒与维权意识的不断提高,环境纠纷已逐渐成为目前大量存在的一种社会纠纷。如何根据我国的国情合理、及时、公正的处理环境纠纷,不仅仅是关系到我国立法、执法、司法等相关法学理论更新的问题,更是关系到我国社会发展战略的实践问题。对环境侵权的受害能否采取适当的救济方式,是保证我国社会稳定与和谐的重要方面。本文的研究目的是将仲裁这种纠纷解决方式纳入到环境纠纷的解决过程中,为日益增多的环境纠纷提供多元化的解决途径,体现仲裁解决环境纠纷的特殊价值。 本文认为,应在修改我国《仲裁法》和《环境保护法》的基础上,制定专门的《环境纠纷仲裁法》,将仲裁机构设置在环保部门内部;设立环境纠纷仲裁员资格认证制度;将中立的第三方引入到仲裁协议的达成过程中,促进环境仲裁协议达成的成功率;在环境仲裁财产保全和证据保全制度中赋予申请人在仲裁前提请财产保全和证据保全的权利。本文共分为四个部分对我国环境纠纷仲裁制度进行阐述: 第一部分是环境纠纷的可仲裁性分析。该部分是整篇文章的理论前提,因为如果想通过仲裁的方式解决环境纠纷,就必须要界定清楚环境纠纷是否具有可仲裁性。对这一部分从三个方面展开论述,第一是环境纠纷具有争议的财产性。通过对争议事项的财产性是争议可仲裁的基础的原因进行分析,结合对环境纠纷概念的界定,得出环境民事财产性纠纷具有争议的财产性的结论。第二是环境纠纷争议的主体地位平等。笔者介绍了环境纠纷的特征:复杂性、主体的不对等性和科学技术性。通过对环境纠纷特征的分析得出环境纠纷争议双方主体地位平等,满足可仲裁争议的标准,具有可仲裁性。第三是环境纠纷的争议具有可处分性。通过以上三部分的分析得出环境民事侵权财产性纠纷满足可仲裁性标准,可以用仲裁的方式加以解决。 第二部分是对建立我国环境纠纷仲裁制度的必要性的研究。该部分首先分析了我国现存的环境纠纷解决的三种方式:协商、行政处理和诉讼。我国目前解决环境纠纷这三种机制的存在都有其价值,但是由于环境纠纷特点的复杂性和环境问题日益剧增的普遍性,现有的环境纠纷解决机制的不足也逐渐显露出来。我国现有的环境纠纷解决机制已经不能满足高效、便捷的解决环境纠纷的需要,因此,寻找和完善环境纠纷的解决方法,探索多元化的环境纠纷解决途径十分必要。随后提出环境纠纷仲裁的概念,通过对环境纠纷仲裁制度在解决环境纠纷中所具有的效率价值和公正价值的分析,揭示了仲裁用于解决环境纠纷蕴含的意义,进而得出我国有必要建立环境纠纷仲裁制度的结论。 第三部分是我国建立环境纠纷仲裁制度的可行性研究。在这部分中,笔者从法律、心理、和实践三个方面进行论证,笔者认为用仲裁的方式解决环境纠纷并不违反我国仲裁法的相关规定,环境纠纷的可仲裁性具有法律基础;对于环境纠纷双方而言,仲裁方式解决环境纠纷恰好满足了纠纷双方都有追求方便、廉价又能公正解决纠纷的处理方式的心理诉求,具有心理基础;国内外运用仲裁解决环境纠纷的成功的经验为我国建立环境纠纷仲裁制度打下了实践基础。通过对这三方面的分析得出我国有建立环境纠纷仲裁制度的法律基础、心理基础、和实践基础,从而得出我国建立环境纠纷仲裁制度是具有可行性的。 第四部分是构建我国环境纠纷仲裁制度的建议。这部分是本篇文章的重点。笔者对我国环境纠纷仲裁制度的建立选取了几个重要问题加以探讨。这些问题有我国建立环境纠纷仲裁制度的基本原则、立法构想、环境纠纷仲裁制度模式的选择、仲裁人员的选择、管辖权问题、环境仲裁协议的达成、环境纠纷仲裁的保全制度问题。在这部分中,笔者提出了自己观点,如在环境纠纷仲裁制度的立法构想中笔者提出在修改我国《仲裁法》和《环境保护法》的基础上,制定专门的《环境纠纷仲裁法》;鉴于环境纠纷的特殊性,将仲裁机构设置在环保部门内部;设立环境纠纷仲裁员资格认证制度;将中立的第三方引入到仲裁协议的达成过程中,促进环境仲裁协议达成的成功率;在环境仲裁财产保全和证据保全制度中笔者提出,应赋予申请人在仲裁前提请财产保全和证据保全的的权利;等等。 限于学识,本文只是就以上问题进行初步的探讨,这些问题只是冰山一脚,我国要想真正建立环境纠纷仲裁制度,还有许多具有重要意义的细节性问题需要在以后的学习和实践中进行更加广泛深入的研究。
[Abstract]:With the citizen's environmental awareness and awareness continues to improve, the environmental dispute has gradually become a kind of social disputes at present there are a lot of. How to according to the situation of our country is reasonable, timely, fair deal with environmental disputes, is not only related to China's legislation, law enforcement, judicial and other related legal theory of the update problem is related to the practical problems of China's social development strategy. The purpose of this study is to the arbitration of the dispute resolution into the process of solving environmental disputes, to provide solutions for the growing diversification the environmental disputes, reflect the special value of arbitration to resolve environmental disputes.
This paper argues that, in the revision of China's arbitration law < > and < > on the basis of environmental protection law, formulate environmental dispute arbitration law > special ", will set the internal arbitration institution in the environmental protection department; the establishment of environmental dispute arbitration qualification system; process will reach a neutral third party to the arbitration agreement. The first part is the environmental dispute arbitration analysis. The second part is the research on the necessity of establishing the environmental dispute arbitration system in China. The first part of the three ways of China's existing environmental dispute resolution: negotiation, administrative management and litigation to resolve environmental disputes in our country at present. The existence of these three mechanisms has its value, but because of the complexity and universality the characteristics of environmental problems of environmental disputes increasing, the shortcomings of the current environmental dispute settlement mechanism is gradually revealed. China's current environmental dispute settlement mechanism has been unable to meet the needs of high efficiency, convenient to resolve environmental disputes, therefore, seek solutions and improve the environmental disputes, explore diversified environmental dispute resolution way is necessary then put forward the concept of environmental dispute arbitration, by analyzing the efficiency value and the fair value of the environmental dispute arbitration system to resolve environmental disputes in which the, It reveals the significance of arbitration in solving environmental disputes, and then draws the conclusion that it is necessary for China to establish an arbitration system for environmental disputes.
The third part is the feasibility study of establishing the environmental arbitration system in our country. In this part, the author from the three aspects of legal, psychological, and practical demonstration, the author thinks that the relevant provisions for arbitration to resolve environmental disputes does not violate our arbitration law, environmental dispute arbitration has a legal basis for; environmental disputes between the parties, the arbitration to resolve environmental disputes just meets the dispute between two parties will pursue the convenient, cheap and psychological treatments can fairly solve the disputes, has a psychological basis; the use of arbitration to resolve environmental disputes at home and abroad the successful experience for our country to establish the environmental arbitration system has laid a practical foundation through the analysis. On the three aspects that China has established the environmental arbitration system of the legal basis, psychological basis and practical basis, so that the establishment of environmental disputes in China Zhong The system of discretion is feasible.
The fourth part is the construction of Chinese environmental dispute arbitration system. This part is the focus of this article. The establishment of the environmental dispute arbitration system in China has selected several important issues to be explored. These problems are the basic principles of establishing the environmental arbitration system of our country, the legislation conception, mode of environmental dispute arbitration system choice, the choice of jurisdiction of arbitration, arbitration agreement, an environmental protection system, the problem of environmental dispute arbitration. In this part, the author puts forward his own views, such as the legislation in the environmental dispute arbitration system proposed in the revision of China's arbitration law < > and < > the basis of environmental protection law on the development of Environmental Dispute Arbitration Law > special "; considering the particularity of environmental disputes, the arbitration mechanism is arranged in the interior of the environmental protection department; the establishment of environmental dispute arbitration qualification certification system will be established in; The third party is introduced into the process of the arbitration agreement to promote the success rate of the environmental arbitration agreement. Limited to knowledge, are discussed in this paper is on the above issues, these problems are only the tip of the iceberg, China wants to establish the environmental disputes arbitration system, there are many important details need to research more extensive and deep study and practice in the future.
