林业习惯法初探

【摘要】：近年来,随着“法律本土化”认识的不断深入,习惯法研究得到了蓬勃发展,可谓硕果累累。综观当前学界对习惯法的研究,其研究领域主要集中于户婚、田土、契约、行会等方面,而环境习惯法研究则显得相对不足,特别是林业习惯法,没有得到习惯法学界应有的重视。事实上,对林业习惯法的研究可以为林业法制建设的进一步完善提供借鉴。基于此,文章试图通过对林业习惯法的历史和现实考察,探究林业习惯法的一般理论,完善林业习惯法的理论体系,发掘林业习惯法的内在价值,以期促进林业法制建设的进一步发展。文章从林业习惯法的概念出发,以法史学和法社会学的视角考察通江、侗族、畲族三地的林业习惯法,在此基础上从林业习惯法的生成和实施以及林业习惯法的效力基础三个方面讨论了林业习惯法的运行机制,分析了林业习惯法与国家制定法之间存在的主要不同及两者之间产生冲突的经济、社会和文化成因,提出了从全面认识林业习惯法、划清林业习惯法与国家制定法的适用范围、构建林业习惯法与国家制定法的对话空间和承认林业习惯法的法源地位四个方面对林业习惯法与国家制定法进行融合的进路,之后以可持续发展和林业法制建设为视角对林业习惯法的现实进行展望,认为林业习惯法自始并将继续存在。
[Abstract]:In recent years, with the "localization of law" the deepening of understanding of customary law has been booming, has made great achievements. In the current academic research on the customary law, the research focuses mainly on marriage, land contract, guild etc., and the study of environmental customary law is relatively insufficient, especially forestry is the customary law, has not been used law due attention. In fact, the study of forestry conventional law can further improve the construction of forestry legal system for reference. Based on this, this article attempts to forestry conventional law of history and reality, the general theory of inquiry forestry of customary law, perfect the theory system of forestry habit the intrinsic value of forestry excavation of customary law, in order to promote the further development of the legal system of forestry construction.
This article from the concept of customary law of forestry law, history and sociology of law from the perspective of Tongjiang, Dong, Yu three forestry conventional law, on this basis, from three aspects of validity basis of customary law formation and implementation of forestry and forestry law discusses the operating mechanism of forestry of customary law, analysis of forestry habits law and statute law and their main difference exists between the conflict between economic, social and cultural reasons, put forward from the comprehensive understanding of Forestry Forestry draw the customary law, customary law and statute law applicable scope, construction of forestry of customary law and statute law dialogue space and recognize the legal status of forestry law four aspects of forestry customary law and statute law fusion approach, then take the sustainable development and the construction of forestry legal system from the perspective of customary law on forestry reality outlook,. For forestry conventional law from the beginning and will continue to exist.
