论水银行制度：以水的存贷与信托为中心

【摘要】：随着人口的快速增长、经济社会的高速发展与人民生活水平的不断提高,对水资源的需求越来越大,如何有效利用越来越稀缺的水资源是全世界面对的迫切需要解决的问题。随着水资源短缺问题的加剧,水资源的经济价值逐步提高,对水的认识和观念、水资源的管理方式将发生很大的变革。水银行是上世纪90年代后国际上出现的一种新型水资源管理模式和指导思想,水银行是水资源的银行,作为水(期待权)交易流转双方的中介,它是调剂用水余缺、节约水交易成本、保障供水安全、加强水资源管理、实现水资源的市场化配置的一个有效工具。本文在总结梳理前人研究的基础之上,讨论了水银行的定义和历史来源,指出水银行充当着取水期待权流转的中介角色,通过进行取水期待权的转化为水票的存贷,优化水资源配置。在此基础上阐述了水银行制度构建的必要性和法理基础,从而从更深层次的角度明确水银行制度建立的重要意义。在运用比较法分析美国、澳大利亚等国家建立水银行成功经验的基础上,探讨了在我国建立水银行的可行性。文章最后通过对上述问题的阐释,提出我国水银行的运行模式可以采取参照银行信托的模式来运作,从而实现水银行制度设计的最终目的,使有限的水资源能够发挥最大的经济和社会效益。
[Abstract]:With the rapid growth of population, the rapid development of social economy and the improvement of people's living standards, the demand for water is increasing, how to effectively use the increasingly scarce water resources is an urgent need to solve the problems facing the world. With the problem of water resources shortage intensifies, the economic value of water resources gradually increase. Ideas for water, water management will be a great change. The water bank is the last century in 90s after the emergence of a new type of international water resources management mode and the guiding ideology, water bank is the Bank of water resources, water (as expected right) transactions intermediary, it is held water supply and demand, water saving transaction costs, and ensure the safety of water supply, strengthen the management of water resources, an effective tool for market allocation of water resources.
Based on the summary of previous studies, discusses the definition and origin of water bank, pointed out that the bank acts as a mediating role of water intake to the circulation of the right, through the transformation of water rights is looking forward to water ticket deposit, optimizing the allocation of water resources. On the basis of the necessity and legal basis of the construction of water bank the system, important to establish clear water bank system from a deeper perspective. Using the method of comparative analysis in the United States, Australia and other countries to establish the water bank based on the successful experience, discusses the feasibility of establishing water bank in our country. Finally, through the explanation of the problem, put forward the running mode of water bank in China can be taken with reference to the bank trust mode of operation, so as to achieve the ultimate goal of water bank system design, so that the limited water resources to maximize the economic and social Benefit.
