云南省抚仙湖水资源保护的法律完善

【摘要】： 水资源是人类最宝贵的自然资源,是人类社会存在和发展的物质基础。随着经济的高速发展,世界范围内的水资源问题越来越严峻,我国水资源污染问题也日益严重。湖泊水资源是水资源的重要组成部分,保护湖泊水资源具有重要的意义。目前抚仙湖水质呈逐年下降、流域生态环境恶化的趋势没有根本解除,抚仙湖水资源保护工作依然严峻。目前,抚仙湖水资源保护的法律体系表面上看已经比较完备,既有国家法律法规也有地方性法规对其进行保护,如《环境保护法》、《水污染防治法》、《水法》、《渔业法》、《水土保持法》、《环境影响评价法》、《云南省环境保护条例》、《抚仙湖保护条例》等,但在实施过程中仍存在着诸多的不足与问题。本论文就是从抚仙湖保护的现有法律问题出发,结合我国水资源保护法制状况,分析研究了与抚仙湖水资源保护有关的立法、执法以及公众环保意识方面的问题。如:在立法上原则性规定过多、可操作性弱、地方立法特色不突出、缺乏对合理利用水资源的规定以及未能明确公众参与原则等;在执法上存在保护和管理体制不健全、相关执法人员的法律责任不明、环境行政执法队伍薄弱和执法力度弱、执法处罚难、政府职能部门间协调不够等问题;另外,由于以前环保宣传教育未深入人心,导致民众环保观念淡薄,难以实现对抚仙湖的长久保护。本论文在分析上述问题的基础上,借鉴国内外关于湖泊环境保护的相关经验,提出了保护抚仙湖的法律完善措施,以期对实际工作有一定的帮助。
[Abstract]:Water resources are the most precious natural resources of mankind and the material foundation for the existence and development of human society. With the rapid development of economy, the problem of water resources in the world is becoming more and more serious. Lake water resources are an important part of water resources, and the protection of lake water resources is of great significance. At present, the water quality of Fuxian Lake is declining year by year. The trend of ecological environment deterioration in the basin has not been fundamentally lifted, and the protection of water resources in Fuxian Lake is still severe. At present, the legal system of water resources protection in Fuxian Lake is on the surface quite complete. It is protected by national laws and regulations as well as local laws and regulations. For example, the Environmental Protection Law, the Water pollution Prevention and Control Law, the Water Law, the Fisheries Law, the soil and Water Conservation Law, the Environmental impact Assessment Law, the Yunnan Province Environmental Protection regulations, the Fuxian Lake Protection regulations, etc. However, there are still many deficiencies and problems in the process of implementation. This paper analyzes and studies the legislation related to the protection of water resources in Fuxian Lake, starting from the existing legal problems in the protection of Fuxian Lake and combining the legal situation of water resources protection in our country. Law enforcement and public awareness of environmental protection, such as: too many legislative principles, weak operability, local legislative characteristics are not prominent, lack of rational use of water resources and lack of clear principles of public participation; There are some problems in law enforcement, such as imperfect protection and management system, unclear legal responsibility of relevant law enforcement personnel, weak and weak environmental administrative law enforcement team, difficult law enforcement punishment, insufficient coordination among government functional departments, etc. Because the environmental protection propaganda and education have not been deeply accepted in the past, the public's concept of environmental protection is weak and it is difficult to protect Fuxian Lake for a long time. On the basis of analyzing the above problems, this paper draws lessons from the relevant experience of lake environmental protection at home and abroad. The measures to protect Fuxian Lake are put forward in order to be helpful to the practical work.
