广州市生活垃圾治理中的法律问题研究

【摘要】：城市生活垃圾排放量随着城市人口的不断增加逐年增多,城市的有限土地面积随着垃圾处理量的增加不断减少,垃圾问题对环境造成的危害随着其对土地的侵蚀不断加重。近年来,环境保护已经成为社会普遍关注的热点问题,而其中垃圾分类这一话题更是频频被提及,城市居民开始在生存之外更关注生活质量,这引起了多个学科、各个领域的众多学者关注。广州市是国内大陆地区首个对垃圾分类治理进行地方立法的城市,并为此研究出了六种分行政区试验的“广州模式”。在内地没有任何可借鉴经验的背景下,研究广州市推进垃圾分类治理工作的进程,不仅有利于理清政府应在垃圾分类治理的公共服务提供中所处的定位,理顺政府与各社会组织在垃圾分类治理中可能存在的合作,而且为内地其他城市甚至为将来农村开展相关工作提供方向上的指引。垃圾分类治理工程不能仅依靠政府的投入,每个公民分类意识的提高、分类活动的参与才是症结。具体而言,本文的论述分为四个部分。首先是对城市生活垃圾的概念及可能混淆的概念进行阐述。其次是对收集到的广州城市生活垃圾分类治理的立法及实践创新现状进行分析,同时介绍美国和日本垃圾分类治理的模式,对比得出广州市在垃圾分类治理领域值得借鉴的部分,以及可以选择性抛弃的部分。最后结合广州市的现状与域外经验的借鉴价值,提出要对垃圾分类问题进行立法,以及建议政府可以通过公共服务外包的模式对垃圾分类实现更高效的治理,同时充分发挥社区优势引导公众参与,且不能忽视对公众垃圾分类意识的培养,促进广州市生活垃圾分类治理的优化。
[Abstract]:With the increasing of the urban population, the amount of municipal solid waste emission increases year by year, and the limited land area of the city decreases with the increase of the amount of garbage disposal. In recent years, environmental protection has become a hot issue of social concern, and the topic of garbage classification has been mentioned frequently. Urban residents are beginning to pay more attention to the quality of life beyond their survival, which has aroused the concern of many scholars in various fields. Guangzhou is the first city in mainland China to legislate on the classification of garbage. For this reason, we have studied the "Guangzhou Model" of six kinds of sub-administrative region trials. Under the background that there is no experience to learn from the mainland, we have studied the process of promoting the classification and treatment of garbage in Guangzhou. It is not only helpful to clarify the position of the government in the provision of public services for classified treatment of garbage, but also to rationalize the possible cooperation between the government and various social organizations in the management of classified waste. In addition, it provides guidance for other cities in the mainland and even for rural areas to carry out related work in the future. Garbage separation and treatment projects cannot rely on government input alone, and each citizen's awareness of classification can be improved. Participation in classified activities is the crux of the matter. Specifically, This paper is divided into four parts. First, the concept of municipal solid waste and the concept of possible confusion are expounded. Secondly, the current situation of legislation and practice innovation of classified treatment of Guangzhou municipal solid waste is analyzed. At the same time, this paper introduces the model of classified treatment of garbage in USA and Japan, and compares the parts that Guangzhou can use for reference in the field of classified treatment of garbage, as well as the parts that can be discarded selectively. Finally, combining with the present situation of Guangzhou and the reference value of overseas experience, It also suggests that the government can achieve more efficient management of garbage classification through the mode of public service outsourcing, and at the same time give full play to the advantages of the community to guide public participation. And we can not ignore the cultivation of public garbage classification consciousness and promote the optimization of municipal solid waste classification and management.
