【摘要】：以水资源可持续发展来保障经济社会的可持续发展,是当今世界面临的共同挑战和紧迫任务。鄱阳湖是我国最大的淡水湖,其水资源的可持续发展对于区域发展乃至整个长江流域的发展,都具有一定的影响力。随着鄱阳湖生态经济区规划的正式实施,鄱阳湖的发展愈发受到社会各界的关注,同时也为社会各界对鄱阳湖的发展研究创造了良好氛围。努力实现鄱阳湖区域水资源的可持续发展,是为了保障鄱阳湖区域公民的平等生存权和环境发展权,也是实现鄱阳湖区域经济社会发展的重要基础。只有将水资源可持续发展、公民权益保护、区域发展与国家社会发展统一协调起来,才能最终在构建和谐社会的语境下彰显其意义。本研究首先从水资源可持续发展的基础理论入手,法学理论从环境权和环境发展权、可持续发展理论、利益与利益机制理论进行探讨,经济学理论从外部性理论、生态经济理论以及资源配置理论进行分析,从而为研究鄱阳湖区域水资源法律问题和法律制度奠定了理论基础。其次,通过对美国、日本两国区域水资源以及五大湖区和莱茵河流域相关水资源法律制度的具体分析,总结归纳出适宜鄱阳湖区域的制度规范及具体措施。再次,通过对鄱阳湖区域水资源可持续发展的现状和已有成果的考察,分析鄱阳湖区域水资源可持续发展过程中存在的问题及产生的原因,主要指鄱阳湖区域法律意识和水资源法律制度保障及运行机制上存在的问题。根据生态保护和经济发展相协调、预防为主与综合治理相结合、公众参与和公众负责相依托的发展原则,构建以鄱阳湖区域水资源主体法律制度、鄱阳湖区域水资源行政管理制度、鄱阳湖区域水资源利益协调制度、鄱阳湖区域水资源生态补偿制度、鄱阳湖区域水资源责任法律制度、鄱阳湖区域水资源纠纷解决制度为主的鄱阳湖区域可持续发展法律制度体系。在此前基础上探讨鄱阳湖区域可持续发展模式,即通过水文化建设、水市场建设、水旅游建设、水生态建设四个方面促进鄱阳湖区域水资源可持续发展的模式选择。最后,通过政策调控层面、技术监督层面、组织运行层面、经济效益层面、文化培育层面的综合考察研究,提出鄱阳湖区域水资源可持续发展的具体对策建议。本论文之研究希冀为鄱阳湖水资源可持续发展日后立法与宏观决策提供一些参考,为构建人与自然和谐发展的鄱阳湖生态经济区建设提供一些新的视角,更希望能为家乡建设添一份绵薄的力量
[Abstract]:It is a common challenge and urgent task for the world to ensure the sustainable development of economy and society with the sustainable development of water resources. Poyang Lake is the largest freshwater lake in China. The sustainable development of its water resources has a certain influence on the regional development and even the development of the whole Yangtze River basin. With the formal implementation of the Poyang Lake Ecological Economic Zone, the development of Poyang Lake has attracted more and more attention from all walks of life. At the same time, it also creates a good atmosphere for the development of Poyang Lake. To realize the sustainable development of water resources in Poyang Lake region is to guarantee the equal rights of survival and environmental development of citizens in Poyang Lake region. It is also an important basis for realizing the economic and social development of the Poyang Lake region. Only the sustainable development of water resources, the protection of the rights and interests of citizens, the regional development and the national social development are unified and coordinated. Only in the context of constructing a harmonious society can its meaning be revealed. This research begins with the basic theory of sustainable development of water resources, discusses the theory of environmental right and environmental development right, the theory of sustainable development, the theory of interest and benefit mechanism, and the theory of economics from the theory of externality. The theory of ecological economy and the theory of resource allocation lay a theoretical foundation for the study of the legal problems and legal system of water resources in Poyang Lake region. Secondly, through the analysis of the United States, The specific analysis of the regional water resources and the relevant water resources legal systems of the five Great Lakes region and the Rhine River Basin in Japan, summarizes and summarizes the system norms and concrete measures suitable for Poyang Lake region. Again, Based on the investigation of the current situation and achievements of the sustainable development of water resources in Poyang Lake region, the paper analyzes the problems existing in the process of the sustainable development of water resources in Poyang Lake region and the causes of its occurrence. It mainly refers to the problems existing in the legal consciousness of Poyang Lake region and the guarantee and operation mechanism of water resources legal system. According to the coordination of ecological protection and economic development, prevention is mainly combined with comprehensive management. Based on the development principles of public participation and public responsibility, this paper constructs the legal system of Poyang Lake regional water resources subject, the Poyang Lake regional water resources administrative management system, the Poyang Lake regional water resources interest coordination system. Poyang Lake Regional Water Resources Ecological compensation system, Poyang Lake Regional Water Resources liability legal system, The legal system of Poyang Lake region sustainable development based on the water resources dispute resolution system in Poyang Lake region. On the basis of previous discussions, the sustainable development model of Poyang Lake region is discussed, that is, through the construction of water culture, water market, water tourism, etc. Finally, through the comprehensive investigation and research of policy regulation, technical supervision, organization and operation, economic benefit and culture cultivation, four aspects of water ecological construction are selected to promote the sustainable development of water resources in Poyang Lake region. The concrete countermeasures and suggestions for the sustainable development of water resources in Poyang Lake region are put forward. The purpose of this paper is to provide some reference for the future legislation and macro decision of Poyang Lake water resources sustainable development, and to provide some new perspective for the construction of Poyang Lake ecological economic zone with harmonious development of man and nature. I hope to add a little strength to the construction of my hometown.
