流域生态补偿法律机制研究

【摘要】： 由于在市场经济条件下，流域上游地区经济发展与流域生态环境保护的矛盾十分突出，因此就需要在法律上明确流域生态的补偿机制，以理顺流域上下游间的生态关系和利益关系，对为流域生态保护做出积极贡献的主体进行补偿，激励上游地区保护流域生态环境，维护生态安全。流域生态补偿是解决流域生态问题的重要途径，各学科的专家从不同的角度，针对流域生态补偿的问题，纷纷提出了自己的独到见解，但对流域生态补偿的理论基础及具体设计却一直未被深入探讨。实行流域生态补偿，还原了流域生态的应有价值，构建出一种流域生态保护的合理机制，不仅是解决流域生态污染的重要途径，而且也有利于缩小区际差距，，促进流域生态的管理和建设，加快上游地区经济发展并有效保护流域生态环境，同时也符合构建和谐社会的精神。本文拟从这个目的出发，首先明确流域生态补偿在各学科中的定义，在全面理解这一制度的内涵和外延的基础上，从我国目前流域生态的现状出发，论证流域生态补偿制度构建的必要性。以我国目前的流域生态为现实基点，分析国内外流域生态管理和补偿制度的经验，然后理性检讨目前我国的流域生态补偿机制的尚不完善之处。最后，从操作层面分析完善这一制度的原则、内容和方法。可以说流域生态补偿制度的构建是在秉承公平、公正的原则下对可持续发展战略的实践，也是对完善环境保护法律体系的进一步探索和实践。
[Abstract]:Under the condition of market economy, the contradiction between the economic development of the upstream region and the ecological environment protection of the river basin is very prominent, so it is necessary to clarify the compensation mechanism of the basin ecology in the law. In order to straighten out the ecological relationship and benefit relationship between the upper and lower reaches of the river basin, the main body that has made positive contribution to the ecological protection of the basin is compensated, and the upstream area is encouraged to protect the ecological environment of the basin. Maintenance of ecological security. Watershed ecological compensation is an important way to solve watershed ecological problems. Experts from different disciplines have put forward their own unique views on the problems of watershed ecological compensation from different angles. However, the theoretical basis and specific design of watershed ecological compensation have not been deeply discussed. The implementation of watershed ecological compensation has restored the due value of watershed ecology and constructed a reasonable mechanism for watershed ecological protection. It is not only an important way to solve the ecological pollution of river basin, but also conducive to narrowing the gap between regions, promoting the management and construction of the basin ecology, speeding up the economic development of the upstream area and effectively protecting the ecological environment of the basin. At the same time, it is also in line with the spirit of building a harmonious society. This paper intends to set out the definition of watershed ecological compensation in various disciplines, on the basis of an overall understanding of the connotation and extension of this system. Based on the present situation of watershed ecology in China, the necessity of constructing watershed ecological compensation system is demonstrated. Based on the present watershed ecology in China, the experiences of watershed ecological management and compensation system at home and abroad are analyzed. Finally, from the operational level, the principles, contents and methods of perfecting this system are analyzed. It can be said that the construction of watershed ecological compensation system is adhering to fairness. The practice of sustainable development strategy under the principle of justice is also a further exploration and practice of perfecting the legal system of environmental protection.
