欧盟可再生能源立法发展及其对我国的启示

【摘要】：气候变化对人类的威胁有愈演愈烈的趋势。人类在采取其他方式应对气候变化的同时,逐步意识到了可再生能源的重要价值。可再生能源作为一个新兴的能源,对其的科学研究和大规模商业开发都仅仅出现在近几十年中。随着可再生能源行业的快速发展,有必要将其纳入立法体系从而对其进行更好的规划与调节。欧盟一直以来都非常重视环境问题,对于可再生能源的开发利用自然不甘人后,伴随着大规模开发可再生能源的是欧盟在可再生能源领域中的广泛而又深入的立法探索。欧盟作为一个国家间的联盟,其在可再生能源领域的立法实践十分曲折而又富有教育意义。本文从立法的角度阐述并分析了欧盟在促进可再生能源利用方面所作的努力。文章首先从欧盟宪法性文件出发,对在欧盟层面进行可再生能源领域的立法的权力进行检验;随后历数欧盟在可再生能源立法进程中所取得的里程碑式的成果;之后重点解读欧盟在可再生能源领域中的现行立法,详细分析其在促进可再生能源发展的过程中如何兼顾各成员国的利益合理分配目标,设计各种方法确保各国认真执行,相互协助,建立各种监督、反馈等措施从而构建一个全面立体的法律体系;文章还将探究一个统一的,自由的可再生能源市场对于达到欧盟目标的意义和可行性及原因和出路。我国已经逐步意识到了可再生能源开发利用的重要意义,并已经开始大规模发展可再生能源。文章将回顾我国在可再生能源领域的发展情况以及我国可再生能源领域中的立法发展过程,之后着重对现行的可再生能源立法进行解读,肯定其立法价值,并介绍其中确立的各项重要措施。文章之后根据前文对欧盟可再生能源立法的经验总结,分析指出我国可再生能源立法中的不足,并借鉴经验,同时结合我国的现状,对中国的可再生能源立法的未来发展提出建议。
[Abstract]:The threat of climate change to mankind is on the rise. While taking other measures to deal with climate change, mankind has gradually realized the important value of renewable energy, which is a new and emerging energy source, With the rapid development of renewable energy industry, it is necessary to bring it into the legislative system so as to better plan and regulate it. The European Union has always attached great importance to environmental issues. The large-scale development of renewable energy is accompanied by the extensive and in-depth legislative exploration of the European Union in the field of renewable energy. The legislative practice in the field of renewable energy is very tortuous and educational. This paper expounds and analyzes the efforts of EU in promoting the use of renewable energy from the angle of legislation. Testing of the power to legislate in the area of renewable energy at the EU level; subsequent milestones in the EU legislative process on renewable energy; It will then focus on the interpretation of existing EU legislation in the field of renewable energy, a detailed analysis of how it can balance the interests of member States in the process of promoting the development of renewable energy, and the design of ways to ensure their serious implementation, The article will also explore the significance and feasibility of a unified, free renewable energy market for achieving the EU's goals, as well as the reasons and ways out for the establishment of a comprehensive legal system through mutual assistance, supervision, feedback and other measures. China has gradually realized the importance of the development and utilization of renewable energy. This paper will review the development of renewable energy in China and the legislative development process in the field of renewable energy, and then focus on the interpretation of the current legislation on renewable energy. It affirms its legislative value, and introduces the important measures established therein. Based on the experience of EU renewable energy legislation, the paper points out the deficiency of our country's renewable energy legislation, and draws lessons from the experience. At the same time, some suggestions on the future development of renewable energy legislation in China are put forward according to the current situation in China.
