京津冀协同环境司法中的集中管辖问题研究

【摘要】:为京津冀协同发展提供环境司法保障,要求对生态环境保护案件实行集中管辖。对案件实行集中管辖,首先要确定其根本动因,进而明确其司法改革的方向与目标,再解决其管辖的范围问题,最后扫除其面临的法律、体制等问题。集中管辖的首要动因是回应环境司法去地方保护主义与生态环境整体性保护的需要,而非环境司法专门化。在授权省内高级人民法院对辖区内生态环境保护案件调整并实施集中管辖的同时,设立以流域为基础的专门性流域法院是集中管辖跨京津冀省级行政区划生态环境保护案件的应然选择。
[Abstract]:In order to provide the environmental judicial guarantee for the coordinated development of Beijing, Tianjin and Hebei, it is necessary to exercise centralized jurisdiction over ecological environmental protection cases.To carry out centralized jurisdiction of cases, we must first determine its fundamental motivation, then clear the direction and goal of its judicial reform, then solve the scope of its jurisdiction, and finally eliminate the legal and institutional problems it faces.The primary motivation of centralized jurisdiction is to respond to the needs of environmental justice to local protectionism and ecological environmental integrity protection, rather than the specialization of environmental justice.While authorizing the higher people's courts in the province to adjust and exercise centralized jurisdiction over ecological environmental protection cases within their jurisdiction,The establishment of specialized watershed courts based on river basins is the appropriate choice for centralized jurisdiction over ecological and environmental protection cases in provincial administrative divisions of Beijing, Tianjin and Hebei.
