论矿业权法律保护的问题与对策

【摘要】：宝贵的矿产资源是国家的资源财富,它为人类生存、现代化建设发展提供了必要条件。矿业权法律制度是保护我国矿产资源得到充分开发利用的重要组成部分,它不仅能为矿产资源保护提供法律手段也对矿产资源开发利用提供有效法律约束,也对我国创立健全的矿业制度提供了理论基础。研究矿业权法律保护问题不仅可以提高对矿产资源的保护,也为我国的矿产资源能得到有效利用和合理开发做出贡献。本文前面部分主要是通过对矿业权概念、性质、特点和国外部分国家的矿业权保护的研究,阐述了我国目前在矿业权立法、矿业权执法、矿业权流转和矿业权有偿使用存在的问题。本文最后部分经过作者对我国出现问题的四个方面的研究,提出了加强我国在矿业权保护方面的对策,为我国建立健全的矿业制度提供理论参考。
[Abstract]:The precious mineral resources are the national resources wealth, which provides the necessary conditions for the survival of human beings and the development of modernization. The legal system of mining rights is an important part of protecting the full exploitation and utilization of mineral resources in China. It can not only provide legal means for the protection of mineral resources, but also provide effective legal constraints for the exploitation and utilization of mineral resources. It also provides a theoretical basis for the establishment of a sound mining system in China. The study on the legal protection of mining rights can not only improve the protection of mineral resources, It also contributes to the effective utilization and rational exploitation of mineral resources in China. The first part of this paper is mainly based on the study of the concept, nature, characteristics and protection of mining rights in some foreign countries. This paper expounds the problems existing in the legislation of mining rights, the enforcement of mining rights, the circulation of mining rights and the paid use of mining rights in China. The countermeasures to strengthen the protection of mining rights in China are put forward, which can provide a theoretical reference for the establishment of a sound mining system in China.
