公众参与环境保护的法律机制研究

【摘要】： 人类与环境的关系是一个古老而崭新的课题,人类在和自然界进行了几千年的抗争之后,极大地发展了自己,增强了改造自然的能力,在其所涉及的各个领域给自然留下了人类活动的深刻印迹。但是,伴随着人类对自然的非理性改造而产生的生态恶化、资源耗竭、环境污染等问题也层出不穷,并成为人类在寻求发展中遇到的一个来自生存空间的大问题。为了有效的解决这一问题,公众参与环境保护的机制应运而生。在我国,虽然政府倡导环境保护已几十载,但是我国的环境污染和生态破坏却仍日趋严重,由此引发的社会矛盾也日益尖锐,其深层次原因之一在于环境保护的公众参与程度低。环境保护要摆脱现在的困境,提高环保领域的民主程度、拓宽公众参与的范围和渠道是必由之路。而这离不开法律的有效保障,因此建立我国公众参与环境保护的法律机制具有紧迫性和必要性。除引言外,本文所涉之具体内容可分为以下五部分: 第一部分是公众参与的一般解析,涉及公众参与的概念界定和背景分析,并在此基础上引导出公众参与环境保护的涵义及其必要性。第二部分是公众参与环境保护的理论基础和价值分析。在论述其理论基础时,主要探讨了公众参与环境保护的环境法学理论基础。环境法学关于公众参与的理论包括:环境公共财产论、环境公共委托论和环境权理论。第三部分是国外公众参与环境保护的法律机制及其经验借鉴。笔者对国外公众参与环境保护的法律机制进行了考察,并在此基础上概括出了可供我国借鉴的经验。第四部分是对我国公众参与环境保护法律机制现状的评析。通过考察我国的相关法律规定,笔者认为我国公众参与环境保护的法律机制已经初具雏形,且正处于向前发展的进程中,但仍然极不完善。第五部分是针对目前我国公众参与环境保护法律机制存在的问题,从建立环境信息公开制度、公众听证会制度、环境问题信访制度等几个方面提出完善我国公众参与环境保护法律机制的构想。
[Abstract]:The relationship between human beings and the environment is an old and new subject. After thousands of years of struggle with nature, human beings have greatly developed themselves and strengthened their ability to transform nature. However, with the irrational transformation of nature, the ecological deterioration, the depletion of resources, the environmental pollution and so on have emerged one after another. In order to solve this problem effectively, the mechanism of public participation in environmental protection came into being. In China, although the government has advocated environmental protection for decades, However, the environmental pollution and ecological destruction in our country are still becoming more and more serious, and the social contradictions caused by them are becoming more and more acute. One of the deep reasons is the low level of public participation in environmental protection. It is necessary to improve the democratic degree in the field of environmental protection and broaden the scope and channels of public participation, which cannot be separated from the effective protection of the law. Therefore, it is urgent and necessary to establish a legal mechanism of public participation in environmental protection in our country. In addition to the introduction, the specific content of this paper can be divided into the following five parts:. The first part is the general analysis of public participation, involving the definition of the concept of public participation and background analysis, and on this basis to guide the meaning and necessity of public participation in environmental protection. The second part is the theoretical basis and value analysis of public participation in environmental protection. This paper mainly discusses the theoretical basis of environmental law of public participation in environmental protection, which includes the theory of environmental public property, the theory of environmental public entrustment and the theory of environmental right. The third part is the legal mechanism of public participation in environmental protection abroad and its experience. The author investigates the legal mechanism of public participation in environmental protection in foreign countries and summarizes the experience that can be used for reference in our country. The fourth part is the analysis of the current situation of the public participation in the environmental protection legal mechanism in China. By investigating the relevant legal provisions of our country, the author thinks that the legal mechanism of public participation in environmental protection in our country has begun to take shape. And is in the process of forward development, but still very imperfect. The fifth part is aimed at the problems existing in the legal mechanism of public participation in environmental protection in our country, from the establishment of environmental information publicity system, public hearing system, This paper puts forward the idea of perfecting the legal mechanism of public participation in environmental protection in several aspects, such as the system of letters and visits on environmental issues.
