【摘要】： 在水资源管理领域引入市场机制,开展水权交易已经成为我国创新水资源管理手段的趋势和学术研究重点。目前,国内学术界在这方面的研究大多停留在对水权的概念辨析以及实施水权交易的必要性和可行性的定性探讨上,缺乏针对具体流域的实证研究。在此背景下,结合广东省东江流域开展水资源分配和调度试点工作的现实需要,研究广东省东江流域水权交易的问题,尤其是政府推动水权交易的作用,具有重大的理论和实践价值。本文首先运用文献研究和实证分析的方法,对广东省东江流域水权交易的实施现状进行梳理,甄别问题并进行原因分析;其次通过比较分析国内外多个地区的水权交易实践,总结归纳国内外政府推动水权交易的共同经验,为完善广东省东江流域水权交易提供经验借鉴。梳理广东省东江流域水权交易的实施现状发现:流域范围内水权交易的交易主体较为明晰,相关法规和规范性文件的出台奠定了交易的产权基础和规则,流域城市的用水缺口构成交易驱动力等等。然而,由于对“市场”与“政府”职能边界的界定不清、立法冲突和立法滞后以及以行政区域管理为主的水资源管理体制障碍,东江流域水权交易尚存在微观主体地位缺失、法制保障不足、管理机构职能错位和管理体系不完整等问题。完善东江流域水权交易应修改现行法律内容以消除立法冲突,加快后续保障性立法;强化流域管理机构的管理职能;构建东江流域水权交易的准流域市场和准地方市场;完善水权交易的政府管理体系;从而拓展水权交易的范围和深度。
[Abstract]:In the field of water resources management, the introduction of market mechanism and the development of water rights trading have become the trend of innovation of water resources management means and the focus of academic research.At present, most of the domestic academic research in this area stay on the concept of water right discrimination and the implementation of water rights trading on the necessity and feasibility of qualitative discussion, lack of empirical research on specific river basins.In this context, in light of the practical needs of the pilot work of water resources allocation and regulation in the Dongjiang River Basin of Guangdong Province, this paper studies the issue of water rights trading in the Dongjiang River Basin of Guangdong Province, especially the role of the government in promoting water rights trading.It has great theoretical and practical value.In this paper, first of all, by using the methods of literature research and empirical analysis, the implementation status of water right trading in Dongjiang Valley of Guangdong Province is combed out, the problems are identified and the causes are analyzed; secondly, the practice of water right trading in many regions at home and abroad is analyzed comparatively.Summing up and summing up the common experiences of the domestic and foreign governments in promoting water right trading, and providing experience and reference for perfecting the water right trade in Dongjiang River Basin of Guangdong Province.Combing the status quo of the implementation of water right trading in Dongjiang river basin in Guangdong province, it is found that the subject of water right trading in the river basin is relatively clear, and the relevant regulations and normative documents have laid the property right foundation and rules for the transaction.The water gap of the river basin city constitutes the driving force of the trade and so on.However, due to the unclear definition of the boundary between "market" and "government", the legislative conflict and legislative lag, and the obstacles of water resources management system based on administrative region management, there is still a lack of microcosmic subject status in water rights trading in Dongjiang River basin.The legal system is not enough, the function of the management organization is misplaced and the management system is not complete and so on.In order to perfect the water right trading in Dongjiang River basin, we should revise the current law content to eliminate the legislative conflict, speed up the subsequent indemnificatory legislation, strengthen the management function of the river basin management organization, construct the quasi-watershed market and quasi-local market of the Dongjiang river basin water right trade.To perfect the government management system of water right trade and expand the scope and depth of water right trade.
