【摘要】：气候变化立法是近年来美国立法领域备受关注的议题之一。本文研究了美国国会气候变化立法进展,重点分析了本届国会众议院通过的《2009年美国清洁能源与安全法》及参议院提出的最新匹配法案《2010年美国能源法》。两份法案在发展核电和海上油气开采、碳排放许可分配、维护碳市场稳定等内容上有一些重要差异。与上届国会气候变化相关法案相比,本届国会的气候变化立法日益强调保障美国的能源安全与独立,促进国内清洁能源技术发展,减少温室气体排放和促进就业。这反映了国际国内形势对美国气候变化立法的影响,以及美国不同政治势力在气候变化问题上的斗争。但是总而言之,美国就温室气体减排立法的根本目的是从本国发展战略考虑,为本国经济的可持续发展和巩固美国在全球的地位服务,而不单是为了应对气候变化和国际压力。
[Abstract]:Climate change legislation is one of the most concerned issues in the field of American legislation in recent years.This paper studies the legislative progress of climate change in the United States Congress, and analyzes the Clean Energy and Security Act of 2009 passed by the current House of Representatives and the latest matching bill proposed by the Senate, the Energy Act of 2010.There are some important differences between the two bills in the development of nuclear power and offshore oil and gas production, the allocation of carbon emissions permits, and the maintenance of the stability of the carbon market.Compared with the climate change related legislation of the previous Congress, the climate change legislation of the current Congress increasingly emphasizes the protection of energy security and independence of the United States, the promotion of clean energy technology in the country, the reduction of greenhouse gas emissions and the promotion of employment.This reflects the impact of the international and domestic situation on climate change legislation in the United States, as well as the struggle of different political forces in the United States on the issue of climate change.But in a word, the fundamental purpose of the U. S. legislation on greenhouse gas emission reduction is to serve the sustainable development of its economy and consolidate its position in the world, not just to deal with climate change and international pressure from its own development strategy.
