民勤水资源保护与利用的法律问题研究

【摘要】： 本文以民勤水资源利用与保护的现状为背景,以技术性的知识和笔者的实地调研资料为基础,从法律的视角,对民勤水资源利用与保护问题的成因进行了分析。并以此为根据,结合我国现行水资源保护的法律规范,提出了加强民勤水资源法律保护的立法建议,即改变立法观念,落实和贯彻可持续发展的立法指导思想,依法保障在民勤水资源利用上实现经济效益、社会效益、生态效益的有机统一;着眼于民勤的用水实际,建构民勤特有的水资源管控办法,设立民勤水利管理委员会,注重对石羊河流域民勤段支流水域的科学管理。笔者认为,通过建立合理的水权制度、健全流域管理的公众参与制度、建立流域生态补偿制度、规范用水行为的审议制度,加强对违法用水行为的查处等,方可将水资源保护的法律在民勤落到实处。
[Abstract]:Based on the current situation of the utilization and protection of water resources in Minqin, based on the technical knowledge and the author's field investigation data, this paper analyzes the causes of the problems in the utilization and protection of water resources in Minqin from the perspective of law.On the basis of this, combined with the current legal norms of water resources protection in China, this paper puts forward some legislative suggestions for strengthening the legal protection of water resources in Minqin, that is, changing the legislative concept, implementing and carrying out the guiding ideology of legislation for sustainable development.To ensure the organic unification of economic, social and ecological benefits in the utilization of water resources in Minqin according to law; to set up the Minqin water conservancy management committee with a view to the actual use of water in Minqin, to construct the management and control measures of water resources peculiar to Minqin;Pay attention to the scientific management of the tributaries in Minqin section of Shiyang River Basin.The author thinks that through establishing reasonable water right system, perfecting the public participation system of watershed management, establishing watershed ecological compensation system, standardizing the deliberative system of water use behavior, strengthening the investigation and punishment of illegal water use behavior, etc.Only then can the law of water resources protection be put into practice in Minqin.
