我国环境影响评价听证制度研究

【摘要】：在环境影响评价中,听证会是公众提出意见交互平台的环评参与方式之一,它能使公众自主的提出对环境影响的意见或表达看法。通过法律、制度的规定并且明确规范环评听证会及实施程序,对有效的举行听证会,征求公众意见,提升环保公众参与,具有前提性的保障作用。 本文以听证程序为切入点,听证程序作为支配环境行政管理活动的重要制度,为环境法制的发展注入了新的生机与活力。在环境影响评价中引入听证程序,提高了环评行政主体工作的透明度,同时也维护了环评相对人的合法权益。 本文主要研究了环评听证制度存在的问题。环评听证主要涉及到环评前期的信息公开、环评听证中的公众参与权保障、环评听证主持人设置、听证代表的产生方式及环评听证形式等问题,通过对这些问题的逐一分析,有针对性的提出了相关完善建议。此外,还提出了加强社会管理,通过借助城乡社区的力量来推动我国环评制度的发展与完善。
[Abstract]:In the environmental impact assessment, the public hearing is one of the ways to participate in the environmental impact assessment, which enables the public to put forward their views or express their views on the environmental impact independently.Through the provisions of laws and regulations and clear norms of environmental impact assessment hearings and implementation procedures, effective hearings, soliciting public opinions, promoting public participation in environmental protection, has a leading role in ensuring.This paper takes the hearing procedure as the breakthrough point, as an important system which dominates the environmental administrative activities, and injects new vigor and vitality into the development of the environmental legal system.The introduction of hearing procedure in environmental impact assessment improves the transparency of the work of the administrative body of EIA and also maintains the legitimate rights and interests of the counterpart of EIA.This paper mainly studies the problems existing in the hearing system of EIA.The EIA hearing mainly involves the disclosure of information in the early stage of the EIA, the protection of the public participation right in the EIA hearing, the setting of the presiding officer of the EIA hearing, the way in which the hearing representatives are produced and the form of the EIA hearing, etc. Through the analysis of these problems one by one,Put forward the relevant consummation suggestion pertinently.In addition, it also proposes to strengthen social management and promote the development and improvement of our country's environmental impact assessment system by means of the strength of urban and rural communities.
