【摘要】：本文概括性的阐述了我国森林资源令人堪忧的现状,对森林资源物权理论进行详细的分析,明确了森林资源的特性以便于从经济价值、生态价值等不同的角度加强对森林资源的管理和保护。通过对物权制度的分析,以及对森林资源物权制度的系统研究,明晰了建立完善的森林资源物权制度是科学管理、利用森林资源的必然要求。在经济全球化的今天,任何国家要发展就必须广泛的吸收和借鉴世界先进的制度和理论。在森林资源物权保护的研究方面外国的起步较早,本文简要介绍了俄罗斯、日本、美国、德国等国家的森林资源物权制度,并总结了国外关于该制度的先进性以及其给我们带来的经验借鉴。借鉴其研究成果也将推动我国相关理论问题的研究。通过对我国现阶段森林资源物权制度现状的客观、深入的分析,总结我国现阶段这方面存在的不足,反复的思考,找出问题的根源所在,并有针对性地提出解决措施。在分析和借鉴国外经验的基础之上,提出了完善我国森林资源物权制度的若干建议。建议从法制方面完善对森林资源的物权的规制,同时健全采伐许可证制度,流转制度等。森林资源物权法律制度的发展和完善,有利于加强对森林资源的保护、经营和管理,实现森林资源的可持续的发展。
[Abstract]:This paper generalizes the worrisome situation of forest resources in our country, analyzes the theory of forest resources real right in detail, and clarifies the characteristics of forest resources in order to facilitate the economic value.Ecological value and other different angles to strengthen the management and protection of forest resources.Through the analysis of the real right system and the systematic research on the real right system of forest resources, it is clear that the establishment of perfect real right system of forest resources is the necessary requirement of scientific management and utilization of forest resources.In today's economic globalization, any country must absorb and draw lessons from the world's advanced systems and theories if it wants to develop.In the field of real right protection of forest resources, this paper briefly introduces the real right system of forest resources in Russia, Japan, the United States, Germany and other countries.And summed up the advanced nature of the system and its experience brought to us.Reference to its research results will also promote the study of relevant theoretical issues in China.Through the objective and in-depth analysis of the present situation of the real right system of forest resources in our country, this paper sums up the shortcomings of this aspect in the present stage of our country, thinks over and over again, finds out the root cause of the problem, and puts forward some measures to solve the problem.Based on the analysis and reference of foreign experiences, some suggestions are put forward to perfect the real right system of forest resources in China.It is suggested to perfect the regulation of the real right of forest resources from the aspects of legal system, and at the same time, to perfect the system of logging permit and circulation, etc.The development and perfection of the legal system of real right of forest resources is conducive to strengthening the protection, management and management of forest resources and realizing the sustainable development of forest resources.
