盲目放生的责任承担与法治完善

【摘要】：放生行为有着深刻的思想意识基础,宗教教义中"培植福报"思想以及人的"趋利避害"本性是这一行为日益多发的背后推手。不合理的放生行为不仅会导致严重的生态后果,还会给放生者带来行政、民事甚至刑事责任。当前我国对放生行为的管控存在立法盲区、监管缺失、教育宣传滞后等弊端,不能有效引导和规制放生行为。未来需在护生、救生、放生有机结合的理念指引下,实施预防为主、源头控制的管理模式,通过完善审批许可、执法联动、公众参与、环境教育等制度手段,有效避免盲目放生导致的人身伤害、外来物种入侵等负面社会效果。

The existing legislation blind, China to control the release behavior of the lack of supervision, abuse of education lag, can not effectively guide and regulate the release behavior. The future life in nursing students, and released the organic combination of the concept under the guidance, the implementation of prevention and control at the source management mode, through the improvement of licensing, joint law enforcement, public participation. Environmental education system, effectively avoid the blind release of personal injury, alien species invasion and other negative social effects.
