武汉市餐厨垃圾回收处置法律制度研究

【摘要】：随着武汉经济的飞速发展和人民生活水平不断地提高,每天产生的餐厨垃圾也越来越多。由于餐厨垃圾产量的不断增多,餐厨垃圾污染也越来越严重,对人类生活环境和人们身心健康构成巨大威胁。对于这些餐厨垃圾如何进行有效管理,不仅是世界各国,特别是我们国家当前面临的重要挑战。一些发达国家对此的主要经验就是在完善相关政策的基础上,适用法律进行管理成为最有效的手段。然而,从事餐厨垃圾回收处置立法,面临许多棘手的问题,比如,如何处理效率与公平的关系,通过建立哪些制度来实现对餐厨垃圾的管理,都涉及一系列的理论和实践问题。而对如何解决这些问题,各国都有自己的国情,解决的路径和制度选择往往大相径庭。武汉的餐厨垃圾管理立法也不可能完全照搬国外的立法,其理论基础也不完全一样。因此,对武汉市餐厨垃圾回收处置立法的理论基础进行研究和探讨,提出切实可行又有充分理论根据的建议,就成为环境法学者义不容辞的职责。本文以对武汉市餐厨垃圾管理情况的调查结果为根据,在参阅许多国内外文献的基础上,结合武汉市餐厨垃圾的相关数据,采用多学科的研究方法,系统阐述了餐厨垃圾回收处置法律制度的理论基础和实践基础以及相关法律制度的构建,以期对武汉市餐厨垃圾回收管理立法起到一定的指导作用。
[Abstract]:With the rapid development of Wuhan economy and the improvement of people's living standard, more and more food waste is produced every day.Due to the increasing production of food waste, the pollution of food waste is becoming more and more serious, which poses a great threat to human living environment and people's physical and mental health.How to manage these wastes effectively is not only an important challenge in the world, especially in our country.The main experience of some developed countries is that on the basis of perfecting the relevant policies, applying the law to manage becomes the most effective means.However, there are many thorny problems in the legislation of recycling and disposal of kitchen waste. For example, how to deal with the relationship between efficiency and fairness, and what system can be established to achieve the management of kitchen waste involves a series of theoretical and practical problems.As to how to solve these problems, each country has its own national conditions.Wuhan's food waste management legislation can not completely copy the foreign legislation, and its theoretical basis is not exactly the same.Therefore, it is the duty of the environmental law scholars to study and discuss the theoretical basis of the legislation on the recovery and disposal of kitchen waste in Wuhan City, and to put forward some feasible and sufficient theoretical suggestions.Based on the results of the investigation on the management of kitchen waste in Wuhan City, and on the basis of referring to many domestic and foreign literatures, and combining with the relevant data of the kitchen waste in Wuhan City, this paper adopts a multidisciplinary research method.This paper systematically expounds the theoretical and practical basis of the legal system for the collection and disposal of kitchen waste and the construction of the relevant legal system in order to play a certain guiding role in the legislation of the collection and management of food waste in Wuhan City.
