论我国公民环境权的宪法属性

【摘要】： 随着环境污染的日益加剧和公民环境保护意识的增强,公民环境权受到越来越多的关注,成为法学界理论探讨的一个热点问题,然而我国现行宪法并没有明确规定公民环境权。宪法制度供给的不足,不利于对公民环境权的充分保护,也使我国整个法律体系对公民环境权的保护呈现出一种低调的状态。本文从环境权的基本问题着手,在环境权理论研究成果的基础之上,借鉴国外公民环境权的立宪经验和实施状况,探讨我国确立公民环境权宪法属性的必要性,分析我国宪法对公民环境权的保护现状,从而确立环境权作为公民基本权利的法律位阶,提出适合我国国情的公民环境权入宪方式。
[Abstract]:With the worsening of environmental pollution and the strengthening of citizens' awareness of environmental protection, citizens' environmental rights have been paid more and more attention, which has become a hot issue in the theory of law circles. However, the current constitution of our country has not clearly stipulated citizens' environmental rights. The insufficient supply of constitutional system is not conducive to the full protection of citizens' environmental rights, and it also makes the protection of citizens' environmental rights in the whole legal system of our country take on a low-key state. Starting from the basic problems of environmental rights and on the basis of the research results of environmental rights theory, this paper discusses the necessity of establishing the constitutional attributes of citizens' environmental rights in our country, drawing on the constitutional experience and implementation of the environmental rights of foreign citizens. This paper analyzes the present situation of the protection of the citizen's environmental right by the constitution of our country, so as to establish the legal rank of the environmental right as the basic right of the citizen, and puts forward the way for the citizen's environmental right to enter the constitution.
