防治外来物种入侵若干立法问题研究

【摘要】： 近些年来,伴随着全球一体化进程的加快及全球范围内的贸易、交通运输、旅游等行业迅速发展,外来物种入侵成为导致生物多样性丧失的第二大因素,仅次于对栖息地的破坏。为了解决外来物种入侵问题,世界上很多国家纷纷制定法律,通过法律手段预防、控制和清除外来入侵物种。我国对外来入侵物种的研究起步较晚,现有法律规定比较零散,且缺乏针对性,难以满足我国外来入侵物种防治的需要。因此,本文运用理论分析、实证分析和比较分析等研究方法,尝试从我国防治外来物种入侵的法律适用困境出发,对我国外来物种入侵防治立法进行分析,反思其中不足;同时借鉴美国、日本、新西兰等外来物种入侵防治先进国家的立法经验,针对我国外来物种入侵防治的立法漏洞,提出完善我国外来物种入侵防治立法的对策。本文认为,我国应以科学发展观为指导,以维持生态平衡、保障生态安全、促进社会经济的可持续发展为立法目的,制定一部专门防治外来物种入侵的法律,同时对现有相关法律规范进行系统的修订,修改其中不利于防治外来物种入侵的内容,制定相应细则以增强防治外来物种入侵法律规范的可操作性,将防治外来物种入侵的法律防治工作落到实处。本文还以外来物种入侵的阶段性特征为基础,尝试建立防治外来物种入侵的全程控制制度,以确保外来入侵物种“从摇篮到坟墓”均在控制之下,为保护我国的生态环境尽抛砖引玉之力。
[Abstract]:In recent years, with the acceleration of the process of global integration and the rapid development of trade, transportation, tourism and other industries around the world, alien species invasion has become the second largest factor leading to the loss of biodiversity. Second only to habitat destruction. In order to solve the problem of alien species invasion, many countries in the world have made laws to prevent, control and eliminate alien invasive species by legal means. The research on invasive alien species in China started late, the existing laws and regulations are scattered and lack of pertinence, so it is difficult to meet the needs of the prevention and cure of invasive alien species in China. Therefore, this paper uses theoretical analysis, empirical analysis and comparative analysis to try to analyze the legislation on the prevention and control of alien species invasion from the dilemma of the legal application of the prevention and control of alien species invasion in China, and to reflect on the shortcomings of the legislation on the prevention and control of alien species invasion. At the same time, based on the legislative experience of advanced countries such as the United States, Japan, New Zealand and other advanced countries, the countermeasures to perfect the legislation of alien species invasion prevention and control in China are put forward in view of the legislative loopholes in the prevention and control of alien species invasion in China. This paper holds that our country should take the scientific development view as the guide, to maintain the ecological balance, to guarantee the ecological security and to promote the sustainable development of the social economy, and to formulate a special law to prevent and control the invasion of alien species. At the same time, the existing relevant laws and regulations are systematically revised, the contents of which are not conducive to the prevention of invasive alien species, and the relevant rules are formulated to enhance the operability of the legal norms for the prevention and control of alien species invasion. To prevent and control alien species invasion of the legal prevention and control work. Based on the stage characteristics of alien species invasion, this paper tries to establish the whole process control system to ensure that the "cradle to grave" of alien invasive species is under control.
