“绿色湖南”建设背景下洞庭湖湿地保护立法问题研究

【摘要】：绿色湖南建设是湖南省委省政府立足省情实际作出的战略部署,是生态文明建设在湖南的生动实践,是美丽中国建设的湖南篇章。洞庭湖湿地是我国重要的湿地生态系统,也是国际重要湿地,在绿色湖南建设中发挥着重要作用。但洞庭湖湿地在开发与利用中存在大量问题,必须加强洞庭湖湿地保护立法,推进洞庭湖湿地流域管理体制改革,使湿地的开发、利用活动规范化、法制化,以健全法制的方式实现湿地生态环境保护的目标。在洞庭湖湿地保护进程中,尽管《湖南省湿地保护条例》为洞庭湖湿地保护提供了基本的制度保障,但由于专门立法的缺失,导致湿地自然资源权属不清,湿地水污染防治措施不系统,各部门片面强调湿地资源的单项管理,没有凸显洞庭湖湿地的重要地位,未能对洞庭湖湿地起到有效的保护作用。因此,应当突出洞庭湖湿地生态环境保护在“绿色湖南”建设中的重要地位,借鉴美、英、日在湿地生态环境保护立法方面的先进经验,对洞庭湖湿地保护进行专门立法。首先,更新其立法模式,采用生态系统管理的立法模式和主流化的湿地环境管理模式；其次,结合洞庭湖湿地的特点,完善其立法的基本原则,在立法中贯彻生态优先原则,推行可持续利用原则,并确立全面规划、因地制宜原则,建立起环境责任原则等；第三,充分考虑洞庭湖湿地生态环境的特殊性,健全洞庭湖湿地保护法律制度,建立与绿色湖南建设要求相适应的统一高效管理体系,保障区域经济社会协调发展,确实推动“绿色湖南”建设。
[Abstract]:The construction of green Hunan is a strategic arrangement based on the actual situation of the province, a vivid practice of the construction of ecological civilization in Hunan, and a chapter of the construction of beautiful China. Dongting Lake Wetland is an important wetland ecosystem in China as well as an international important wetland, which plays an important role in the construction of green Hunan. However, there are a lot of problems in the development and utilization of Dongting Lake wetland. It is necessary to strengthen the protection legislation of Dongting Lake wetland, to promote the reform of management system of Dongting Lake wetland basin, to make the wetland development and utilization standardized and legalized. To improve the legal system to achieve the goal of wetland ecological environment protection. In the process of wetland protection in Dongting Lake, although the regulations on Wetland Protection of Hunan Province provide the basic institutional guarantee for the wetland protection of Dongting Lake, due to the lack of special legislation, the ownership of wetland natural resources is unclear. The measures of wetland water pollution prevention and control are not systematic, all departments emphasize the single management of wetland resources unilaterally, do not highlight the important position of Dongting Lake wetland, and fail to play an effective role in protecting Dongting Lake wetland. Therefore, we should highlight the important position of ecological environment protection of Dongting Lake wetland in the construction of "green Hunan", draw lessons from the advanced experience of the United States, Britain and Japan in the legislation of wetland ecological environment protection, and make special legislation on the wetland protection of Dongting Lake. First of all, we should update its legislative model, adopt the legislative model of ecosystem management and the mainstream wetland environmental management model; secondly, combine the characteristics of Dongting Lake wetland, perfect the basic principles of its legislation, and implement the principle of ecological priority in legislation. Promote the principle of sustainable use, establish comprehensive planning, adapt measures to local conditions, establish principles of environmental responsibility, etc. Third, take full account of the particularity of the ecological environment of the Dongting Lake wetland, and improve the legal system for the protection of the wetland in Dongting Lake, The establishment of a unified and efficient management system adapted to the requirements of the construction of green Hunan ensures the coordinated development of regional economy and society and promotes the construction of "green Hunan".
