新农村生态环境保护法制研究

【摘要】：随着人口的不断增长以及经济的飞速发展,农村环境污染日益加剧,针对该现状进行分析,并提出了相应的法律防治对策,包括应加强农村环境保护法制宣传,完善立法,严格执法,有效遏制农村环境污染。近年来,“三农”问题在全国范围内引起了广泛的关注,解决“三农”问题,建设社会主义新农树是全面建设小康社会的内在要求。农村人口占绝大多数,全面建设小康社会重点在农村,难点在农村,广大农村地区能否达到全面建设小康社会的要求,是实现更高水平的小康社会的关键一步。在依法治国的今天,实践证明运用法律手段保护农村环境是最有效的途径,只有通过制定农村环境保护法规和不断提高农村环境保护执法水平,农村环境问题才能得到根本的解决。本文从农田、水体、植被、生物多样性、大气等方面分析了我国农村生态环境的现状,以及引起农村生态环境问题的原因,提出和分析了我国现行农村生态环境保护法律体系中存在的问题,并从公共环境意识、经济手段、所有权、行政领导责任制,立法和执法方面,提出了建立我国农村环境保护法律体系的对策。
[Abstract]:With the continuous growth of population and the rapid development of economy, the environmental pollution in rural areas is becoming more and more serious. This paper analyzes the present situation and puts forward the corresponding legal countermeasures, including strengthening the legal publicity of rural environmental protection and perfecting the legislation. Strictly enforce the law to effectively curb environmental pollution in rural areas. In recent years, the issue of "agriculture, countryside and farmers" has aroused widespread concern in the whole country. To solve the problem of "agriculture, rural areas and farmers" and to build a new socialist agricultural tree is the inherent requirement of building a well-off society in an all-round way. The rural population accounts for the vast majority. The key to building a well-off society in an all-round way lies in the countryside, and the difficulty lies in the countryside. Whether or not the vast rural areas can meet the requirements of building a well-off society in an all-round way is a key step to achieve a higher level of well-off society. In today's rule of law, practice has proved that legal means to protect the rural environment is the most effective way, only through the formulation of rural environmental protection laws and regulations and constantly improve the level of rural environmental protection law enforcement. Rural environmental problems can be fundamentally resolved. This paper analyzes the present situation of the rural ecological environment in China from the aspects of farmland, water body, vegetation, biodiversity and atmosphere, and the causes of the rural ecological environment problems. This paper puts forward and analyzes the problems existing in the current legal system of rural ecological environment protection in China, and from the aspects of public environmental consciousness, economic means, ownership, administrative leadership responsibility system, legislation and law enforcement. The countermeasures of establishing the legal system of rural environmental protection in China are put forward.
