【摘要】：全球经济快速发展使我们的生活发生了翻天覆地的变化，但环境问题却日渐凸显，如城市热岛效应、绿地面积减少、土地沙漠化、水体污染、一些动植物资源濒临灭绝等。我们生存的环境不断恶化，传统的城市绿化已不能在发展与环境保护之间找到平衡点，不能解决城市土地资源紧缺与环境恶化的矛盾，城市环境的不断恶化提醒我们发展立体绿化已迫在眉睫。屋顶绿化是立体绿化的一种，且城市中有大量的屋顶空间没有得到合理的利用，脏乱差的屋顶严重影响着城市的俯视景观。屋顶绿化能够充分的利用城市的屋顶空间，美化城市的天面，改变城市的俯视效果，提升城市的形象。现今，屋顶绿化是改善城市环境的最优选择，推广屋顶绿化已成为国际的共识。屋顶绿化能有效地利用城市空间，增加城市绿化率，改善城市环境，节约城市土地资源。不仅能够带来环境效益，还能产生可观的经济效益、社会效益和生态效益，也正是基于屋顶绿化的效益功能国外各国纷纷立法推进屋顶绿化的发展，制定屋顶绿化的强制措施和鼓励性政策，进行广泛的宣传，成立屋顶绿化的实验基地等措施大力发展屋顶绿化。相比而言，我国屋顶绿化起步晚，屋顶绿化的法律法规建设缺位，法律保护不足，相应的政策制定找不到适合的法律基准，屋顶绿化的发展举步维艰，，发展中遇到诸多的法律问题。本文就相关的法律问题分三部分进行剖析，探讨我国屋顶绿化的法制建设之路。第一部分：屋顶绿化的概述。该部分简要介绍了屋顶绿化的概念，屋顶绿化的建筑结构要求，屋顶绿化的效益以及屋顶绿化的发展前景展望。第二部分：国内外屋顶绿化的法律保护。该部分主要介绍国内外屋顶绿化的相关法律法规及政策，总结我国屋顶绿化法律保护的不足，借鉴国外立法发展屋顶绿化的经验。第三部分：我国发展屋顶绿化需要解决的相关法律问题。该部分主要探讨我国屋顶绿化立法的位阶，提出屋顶绿化条例的框架，综合民法屋顶平台专用使用权的研究，探讨我国屋顶平台共有状态下屋顶绿化发展的制度之路，并提出专门用于绿化使用的屋顶平台专用绿化使用权，并对其内容加以详细阐述。同时对屋顶绿化发展的商业开发问题、审批建设问题及监督管理问题加以探讨。
[Abstract]:With the rapid development of global economy, our life has changed dramatically, but the environmental problems have become increasingly prominent, such as urban heat island effect, decreasing green space area, desertification, water pollution, and some animal and plant resources are on the verge of extinction. The environment in which we live is deteriorating, and the traditional urban greening cannot find a balance between development and environmental protection, nor can it solve the contradiction between the shortage of urban land resources and the deterioration of the environment. The continuous deterioration of the urban environment reminds us of the urgent need to develop three-dimensional greening. Roof greening is a kind of stereoscopic greening, and a large number of roof space in the city has not been used reasonably, and the dirty roof seriously affects the overlooking landscape of the city. Roof greening can make full use of the city's roof space, beautify the city's sky, change the city's overlooking effect, and promote the image of the city. Nowadays, roof greening is the best choice to improve urban environment. Roof greening can effectively utilize urban space, increase urban green rate, improve urban environment and save urban land resources. It can not only bring environmental benefits, but also produce considerable economic, social and ecological benefits. It is also based on the benefits of roof greening that many countries abroad have legislated to promote the development of roof greening. Making compulsory measures and encouraging policies for roof greening, carrying out extensive propaganda, setting up experimental base of roof greening, and so on, vigorously developing roof greening. Comparatively speaking, the roof greening of our country starts late, the law and regulation construction of roof greening is absent, the legal protection is insufficient, the corresponding policy formulation cannot find the suitable legal benchmark, and the development of the roof greening is very difficult. Many legal problems have been encountered in the course of development. This paper analyzes the related legal problems in three parts and probes into the road of legal construction of roof greening in China. The first part: the outline of roof greening. This part briefly introduces the concept of roof greening, the structural requirements of roof greening, the benefits of roof greening and the prospect of roof greening. The second part: the legal protection of roof greening at home and abroad. This part mainly introduces the relevant laws, regulations and policies of roof greening at home and abroad, summarizes the shortage of legal protection of roof greening in our country, and draws lessons from the experience of foreign countries in legislating to develop roof greening. The third part: the development of roof greening in China needs to solve the relevant legal problems. This part mainly discusses the rank of the legislation of roof greening in our country, puts forward the frame of the regulation of roof greening, synthesizes the study of the special right to use the roof platform in civil law, and probes into the system of the development of roof greening under the common state of the roof platform in our country. The special greening right of roof platform used for greening is put forward, and its content is expounded in detail. At the same time, the commercial development, examination and approval, supervision and management of roof greening development are discussed.
