论我国环境知情权及其法律保护

【摘要】： 环境知情权作为一项权利,最先起源于行政法上的知情权制度。它是指公众对本国乃至世界的环境状况、国家的环境管理状况以及自身的环境状况等有关信息充分获取、易获取的权利。环境知情权是为了弥补环境权在法律实现上存在的不足而提出的。我国2003年“开县井喷”和2005年“松花江水污染”两起典型的环境污染事件的突发,暴露了我们对环境知情权的研究不足以及在立法和实践中的严重缺位。2008年《政府信息公开条例》和《环境信息公开办法(试行)》的实施为保障我国公民环境知情权提供了法律依据。然而,法律的生命在于它的实行,一系列侵害环境知情权案件的频频发生表明,只有进一步完善我国环境知情权的法律制度,积极推动现有法律的有效实施和适用,才能尊重和维护公众环境知情权利。文章从环境知情权的基本理论问题入手,按照“提出问题—分析问题—解决问题”的基本思路,对我国及国外主要发达国家和地区环境知情权的法律保护制度进行了梳理和研究,提出从立法、执法和司法三个环节构建我国环境知情权法律保护制度的框架性思考。将文章主体分为五个部分进行阐述: 第一部分运用综合分析方法,主要研究环境知情权的基本理论问题。首先,简要介绍了环境知情权提出的背景;其次,在综合理论界观点的基础上,对环境知情权的基本概念和性质予以界定,认为环境知情权在性质上是环境权的一项派生权利,是一项程序性权利,是知情权在环境保护领域的民主行政的体现;最后,阐述了环境知情权的三个构成要素:权利义务主体、客体和权利内容。第二部分挖掘和分析环境知情权的实现路径。包括制度性路径和非制度性路径。环境信息公开是实现环境知情权的前提和基础,主要方式是环境信息公开义务主体主动公开环境信息和根据权利主体申请被动公开环境信息,具体到我国包括政府环境信息公开和企业环境信息公开,此为制度性路径,需要建立制度,用法律予以规制。此外,个人、民间团体和新闻媒介等自发的传播环境信息,也是环境知情权的实现路径之一,为非制度性路径,需要予以重视,加以正确引导。第三部分和第四部分运用实证分析方法和比较分析方法,主要阐述了国外和国内环境知情权保护的现状。首先对国外主要发达国家和地区(主要包括欧盟、美国和日本)环境知情权保护的先进成熟的法律制度进行分析,并归纳如下可供我国借鉴之处:环境知情权规定明确;权利主体更加广泛;义务主体扩大;企业、产品环境信息公开成为新的发展方向;公众参与制度备受重视。其次结合国内外环境知情权保护现状及相关案例,提出我国环境知情权保护方面存在的立法不足和实践缺陷,如立法未明确规定环境知情权;现有立法缺乏统一性;公开信息内容和形式不充分、专业性强;企业、产品环境信息公开可操作性差;公众参与制度不健全;救济途径不完善等。第五部分提出完善我国环境知情权法律保护的框架性思考:第一,立法环节,加快法制建设,完善环境知情权法律保护体系;第二,执法环节,切实实施已有法律法规,完善环境知情权实现机制;第三,司法环节,参考和借鉴国外规定,完善司法救济制度。从立法、执法和司法三个环节对环境知情权法律保护进行了全面思考,提出了以下具体建议:立法中明确规定环境知情权,出台专门的环境信息公开法,制定突发性环境事故信息披露细则,完善环境信息披露审计制度;完善环境信息公开内容和形式,细化政府、企业、产品环境信息公开机制,保障公众主动申请获得环境信息的权利,强化公众参与制度;完善与现有立法配套的司法解释,强化行政复议和行政诉讼的适用,完善我国的司法审查制度等。
[Abstract]:As a right , the right to know the environment is originated from the system of information right in the administrative law . It refers to the public ' s insufficient research on the environment condition of the country and even the world , the state ' s environmental management situation and its own environmental condition .

Based on the basic theory of the right of environmental information , the article combs and studies the legal protection system of the right to know the environment in the major developed countries and regions abroad according to the basic idea of " putting forward the problem - analyzing the problem - solving the problem " , and puts forward the framework thinking of constructing the legal protection system of environmental information right in our country from the three aspects of legislation , law enforcement and judiciary .

The first part uses the comprehensive analysis method to study the basic theory of the right of environmental information . Firstly , the basic concept and nature of the right of environmental information is defined based on the viewpoint of comprehensive theory , and it is considered that the right of environmental information is a derivative right in the field of environmental protection , and it is a procedural right which is the reflection of the democratic administration in the field of environmental protection . Finally , three elements of the right to know the environment are expounded : the subject , object and right content of the rights and obligations .

The second part is to explore and analyze the realization path of environmental information right , including institutional path and non - institutional path .

The third part and the fourth part use the empirical analysis method and the comparative analysis method to analyze the situation of the foreign and domestic environment information right protection . First , it analyzes the legal system of the protection of the environment information right in the major developed countries and regions ( mainly including the European Union , the United States and Japan ) .

The fifth part puts forward the framework of perfecting the legal protection of environmental information right in our country : the first , the legislative link , speeding up the construction of the legal system , perfecting the legal protection system of the environmental information right ;
