【摘要】：去年12月12日,《鄱阳湖生态经济区规划》获得国务院正式批复,标志着建设鄱阳湖生态经济区已经上升为国家战略。这是新中国成立以来,我省第一个列为国家战略的区域性发展规划,是我省发展史上的重要里程碑。立法保护鄱阳湖的“一湖清水”,走科学发展、绿色崛起之路,是落实科学发展观,实施《鄱阳湖生态经济区规划》的必然选择,是全省人民的共同心愿,有利于以维护人民群众的利益为根本出发点,用统筹兼顾的方法协调经济发展、社会进步、环境保护的关系,把经济社会纳入全面协调可持续发展的轨道。从全球范围来看,立法保护重要湖泊的生态环境已成为一种趋势。立法保护鄱阳湖生态环境,必须掌握鄱阳湖生态环境的现状及存在的问题,充分认识鄱阳湖生态环境保护立法的积极意义,明确其主要内容。本文试图从鄱阳湖生态环境保护立法应当遵循的原则,保护规划,立法调整的对象,保护的客体和范围,主要目标,保护措施及其生态环境补偿机制,保护与发展的关系,管理体制以及法律责任的设置提出了立法构想。
[Abstract]:On December 12 last year, the "Poyang Lake Ecological Economic Zone" was officially approved by the State Council, indicating that the construction of Poyang Lake Ecological Economic Zone has become a national strategy. This is the first regional development plan listed as a national strategy since the founding of New China. It is an important milestone in the history of development of our province. Legislation to protect Poyang Lake's "one lake clear water", to take the road of scientific development and green rise, is the inevitable choice to implement the "Poyang Lake Ecological Economic Zone Planning" and is the common wish of the people of the whole province. It is advantageous to coordinate the relations among economic development, social progress and environmental protection by taking the interests of the people as the basic starting point, and to bring the economy and society into the track of overall coordinated and sustainable development. From a global perspective, legislation to protect the ecological environment of important lakes has become a trend. In order to protect the ecological environment of Poyang Lake by legislation, we must grasp the present situation and existing problems of the ecological environment of Poyang Lake, fully understand the positive significance of the legislation of ecological environment protection of Poyang Lake, and clarify its main contents. This paper attempts to follow the principles of the legislation of ecological environment protection in Poyang Lake, the protection planning, the object of legislative adjustment, the object and scope of protection, the main objectives, the protective measures and the compensation mechanism of ecological environment, and the relationship between protection and development. The management system and the establishment of legal responsibility put forward the legislative conception.
