中美环境行政执法若干问题比较研究

【摘要】： 环境问题是当今世界发展所急需应对的重大问题,各国都采取了积极的管理措施和有效的执法手段来保证自己的可持续发展。环境行政执法是各项环境法律、法规得以顺利实施的重要保障。美国作为发达的资本主义国家在环境保护方面开始较早,有着丰富的管理经验,具有典型的学习意义,因此本文从立法模式、执法目的、执法主体、执法行为和救济制度等方面,对中美两国的环境行政执法进行比较研究,指出我国环境行政执法中存在的问题,剖析这些问题的形成原因,旨在借鉴发达国家的先进经验和有益做法,提出完善我国环境行政执法的对策。我国在环境保护上虽然有着悠久的历史,但环境行政执法制度还很不完善,尤其在具体执法上仍然相当落后,通过对中美环境行政执法制度上的纵深比较,借鉴美国的环境管理经验对于加强和改善我国环境行政执法制度,对于中国环境管理体制的创新和环境行政执法的完善,促进经济和社会的可持续发展,都具有十分重要的现实意义。
[Abstract]:Environmental problem is an important problem in the development of the world today. All countries have taken active management measures and effective law enforcement measures to ensure their sustainable development. Environmental administrative law enforcement is an important guarantee for the smooth implementation of environmental laws and regulations. The United States, as a developed capitalist country, started earlier in environmental protection, has rich management experience, and has typical learning significance. Therefore, this paper focuses on the legislative model, the purpose of law enforcement, and the main body of law enforcement. In the aspects of law enforcement behavior and relief system, this paper makes a comparative study of the environmental administrative law enforcement in China and the United States, points out the problems existing in our country's environmental administrative law enforcement, and analyzes the reasons for the formation of these problems. The purpose of this paper is to draw lessons from the advanced experiences and beneficial practices of developed countries and put forward countermeasures to perfect our country's environmental administrative law enforcement. Although our country has a long history in environmental protection, the environmental administrative law enforcement system is still very imperfect, especially in the specific law enforcement is still quite backward, through the in-depth comparison between China and the United States environmental administrative law enforcement system. Drawing lessons from the experience of environmental management in the United States can strengthen and improve the system of environmental administrative law enforcement in China, innovate the system of environmental management in China and perfect the law enforcement of environmental administration, and promote the sustainable development of economy and society. All have very important realistic significance.
