循环经济理念下的清洁生产立法问题研究

【摘要】： 要实现经济的良性循环,实现人与自然的协调发展,我国未来必须以循环经济作为经济发展的基本模式,以构建循环型社会作为未来发展的目标。良好完善的循环经济法律制度将成为实现这一目标的关键因素之一。我国的循环经济立法应当立足于国情,坚持从实际出发,有计划地循序渐进,逐步建立起完备的循环经济法律体系。发展循环经济并不是必然要求立即制定一部循环经济法,而且客观上循环经济本身的系统性与复杂性也决定了它的建立绝不是一部《循环经济促进法》就能完成的,而是应该树立循环经济理念,充分利用已有的法律资源,修改完善相关法律法规,将循环经济的理念注入其中,这也可以说是向循环经济立法迈进。清洁生产是发展循环经济的第一阶段,清洁生产立法是循环经济立法体系的重要组成部分,因此从我国实际出发,加强和完善清洁生产立法是我国近期建立循环型社会发展战略的现实选择。论文从厘清清洁生产立法与循环经济立法的关系入手,明确了清洁生产立法在循环经济法律体系中的地位,认为在当前循环经济由理念向法制转变的进程中,加强和完善清洁生产立法能够有效地促进循环经济法律体系的建构和发展,并进一步提出了在循环经济理念之下完善清洁生产立法的思考和建议。旨在以促进循环经济的实施和循环型社会的建立为目的,研究在循环经济理念下如何完善现有的清洁生产法律,从而推进循环经济立法体系的发展。正文共分为四个部分: 第一部分是相关概念辨析。介绍了循环经济及清洁生产的相关概念,并对二者的关系进行了论证。认为清洁生产是循环经济的基础,是循环经济发展的第一阶段,也是实现循环经济的必经阶段。第二部分是清洁生产与循环经济之立法比较。首先介绍了清洁生产和循环经济的立法发展概况,阐述了循环经济的立法理念。认为循环经济作为新型经济模式,相应地树立了新的立法理念,例如可持续发展、主体多维化、利益多元化、责任至上及合作共生等理念。进而将清洁生产与循环经济在立法背景、立法性质、立法行政管理体制、立法的强制性等方面进行了比较。第三部分是循环经济与清洁生产立法的衔接。首先对二者的立法衔接问题就有关学者的观点进行了综合分析,进而提出了本文观点,即清洁生产立法在循环经济立法体系中位于第二个层次,其立法是为了实现在生产领域以污染预防为目的的清洁生产。清洁生产法应当在循环经济基本法的统帅之下,同各综合性法律与具体法律法规相辅相成,形成完整协调的循环经济法律体系。第四部分是完善清洁生产立法之思考。认为当前要按照循环经济的立法理念完善清洁生产立法。循环经济的可持续发展理念要求促进经济与环境的深层次的结合,要求适时制定农业、服务业等领域的清洁生产法律法规,要求填补立法空白,扩大立法的适用范围。利益多元化理念要求完善清洁生产管理体制,明确各级政府的清洁生产主导职责和环境保护部门的监督管理职责,以提高管理效率,实现对各类主体利益的平衡。要以发展循环经济为导向,制定相应的配套法规和实施细则,增强其可操作性。主体多维化理念要求在立法中增强各法律主体的责任等等。
[Abstract]:In order to realize the virtuous circle of economy and realize the harmonious development of man and nature , the future of our country must take the circular economy as the basic mode of economic development , so as to build a circular economy legal system .

This paper starts with clarifying the relationship between clean production legislation and circular economy legislation , clarifies the status of cleaner production legislation in circular economy legal system , thinks that strengthening and perfecting cleaner production legislation can effectively promote the construction and development of circular economy legal system in the process of changing the current circular economy from idea to legal system , and further puts forward the thinking and suggestion to perfect clean production legislation under the idea of circular economy .

The text is divided into four parts :

In the first part , the concept of recycling economy and clean production is introduced , and the relationship between them is demonstrated . It is believed that cleaner production is the basis of circular economy , and it is the first stage of circular economy development and the necessary stage to realize the circular economy .

The second part is the legislative comparison of cleaner production and circular economy . Firstly , the legislation development of cleaner production and circular economy is introduced , and the legislative idea of circular economy is introduced . The circular economy is considered as a new economic model , and the idea of new legislation concept such as sustainable development , principal multi - dimensional , benefit pluralism , responsibility top and cooperation symbiosis are set up accordingly .

The third part is the connection between the circular economy and the clean production legislation . First of all , the author makes a comprehensive analysis on the legislative cohesion problem of the two , and then puts forward the view that the clean production legislation lies at the second level in the circular economy legislation system . The legislation of the clean production is to realize the cleaner production aiming at the pollution prevention in the production field . The clean production law should be combined with the specific laws and regulations in order to form a complete and coordinated circular economy legal system under the general manager of the Basic Law of the Circular Economy .

The fourth part is to perfect the legislation of clean production . The idea of sustainable development of circular economy calls for the promotion of the deep integration of economy and environment , and calls for the establishment of clean production laws and regulations in the fields of agriculture , service industry and so on .
