环境公法领域相邻关系问题解决途径探求

【摘要】：传统民法相邻关系通过理论、实践上的创新,在解决"涉及环境因素的相邻关系"问题上已日渐成熟,许多民法学者希望通过民法的进一步"绿化",使民法的相邻关系具有解决环境公法领域相邻关系问题的包容性。然而,由于民法相邻关系无法跳出物权体系,且基于私法的本质,必然体现着私法规范个别调整和事后救济的共性。这就决定了在公法领域照搬民法相邻关系会出现诸多问题。因此,随着公法相邻关系理论的提出,通过环境公法规范来调整环境公法领域的相邻关系问题具有合理性和优越性。
[Abstract]:Through the innovation of theory and practice, the contiguous relation of traditional civil law has become more and more mature in solving the problem of "adjacent relation involving environmental factors". Many civil law scholars hope that through the further greening of civil law, the adjacent relationship of civil law will be inclusive to solve the problem of adjacent relationship in the field of environmental public law. However, because the adjacent relation of civil law can not jump out of the system of real right, and based on the essence of private law, it must reflect the commonness of individual adjustment and relief of private law. This determines that there will be many problems in copying the adjacent relations of civil law in the field of public law. Therefore, with the development of the theory of adjoining relation in public law, it is reasonable and advantageous to adjust the adjacent relation in the field of public environmental law through the norms of public environmental law.
