论我国环境保护中的行政奖励制度

【摘要】：在国民经济不断发展的今天,环境问题日益严峻,但是我国环境保护经过二十余年的发展,虽然取得了丰富的成果,但也出现很多问题。其中一个重要原因是由于目前我国对于环境保护管理工作主要以行政处罚和监督检查为主,缺少必要的奖励机制,不能有效调动企业、社会和公众的环境保护积极性,不能引导全社会的力量为环境保护事业服务。因此环境保护工作亟待实现重大政策创新,建立完善企业守法、循环经济、节能减排、环保财政、流域治理等激励机制。笔者认为行政奖励制度与环境保护相结合是中国环境保护法律制度的发展方向,是一种趋势。首先,界定我国环境保护中的行政奖励制度的定义与特征,阐述我国环境保护中行政奖励制度的立法现状,从行政奖励实施主体、行政奖励实施对象、行政奖励实施条件和行政奖励实施程序四个方面分析我国环境保护中的行政奖励制度存在的问题。其次,从我国环境保护中的行政奖励制度法律观念落后、行政奖励实施条件不明确以及行政奖励执法不规范三个方面分析我国环境保护中行政奖励制度问题的成因。第三,针对我国环境保护行政奖励制度的缺陷,结合对我国环境保护中的行政奖励制度中局限性的思考,从行政奖励制度实施主体,行政奖励制度实施对象,行政奖励制度实施条件,行政奖励制度实施程序等方面提出了完善建议。
[Abstract]:Today, with the development of national economy, the environmental problems are becoming more and more serious. However, after more than 20 years' development, China's environmental protection has made a lot of achievements, but there are also many problems. One of the important reasons is that at present, administrative penalties, supervision and inspection are the main causes of environmental protection management in our country, and the necessary incentive mechanism is lacking, which can not effectively mobilize the enthusiasm of enterprises, society and the public for environmental protection. Cannot guide the whole society's strength to serve the environmental protection cause. Therefore, it is urgent for environmental protection to realize major policy innovation, and to establish and perfect incentive mechanisms for enterprises to abide by the law, circular economy, energy saving and emission reduction, environmental finance, watershed management, and so on. The author thinks that the combination of administrative reward system and environmental protection is the development direction and trend of China's environmental protection legal system. First of all, it defines the definition and characteristics of the administrative reward system in environmental protection of our country, expounds the current legislative situation of the administrative reward system in the environmental protection of our country, from the administrative reward implementation main body, the administrative reward implementation object. This paper analyzes the problems existing in the administrative reward system in the environmental protection of our country from four aspects: the administrative reward implementation condition and the administrative reward implementation procedure. Secondly, this paper analyzes the causes of the problems of the administrative reward system in environmental protection from three aspects: the backward legal concept of the administrative reward system in our country, the unclear conditions for the implementation of the administrative reward and the irregular enforcement of the administrative reward. Thirdly, aiming at the defects of the administrative reward system of environmental protection in our country and considering the limitations of the administrative reward system in the environmental protection of our country, from the main body of the administrative reward system, the object of the administrative reward system, Administrative reward system implementation conditions, administrative reward system implementation procedures and other aspects proposed to improve the proposal.
