东平湖湿地生态系统管理法律研究

【摘要】：东平湖湿地的形成历史悠久,生物资源丰富多样,是城市湿地生态系统的重要组成部分,在提供水资源、调节气候、涵养水源、均化供水、降解污染物、保护生物多样性等方面发挥着重要的生态功能。然而,在自然与社会经济发展多重因素的共同作用下,湿地生态环境与功能不断恶化,直接影响了湿地生物的进化发展,湿地生态系统表现出:水质严重富营养化,生态环境破碎化、片段化,动物、植物种濒临消亡,底泥污染等严重破坏的现状,最终导致了湿地生态系统抗干扰能力的下降。当前,湿地存在的种种生态问题,凸显出东平湖湿地法律保护存在着诸多不足与缺陷,给实际具体依法管理带来重重困难。传统的单一生态环境保护与治理措施包括生态环境法制途径在内的保障无力与不足都是因为缺乏一种湿地生态系统整体保护的理念。近年来,以湿地资源可持续利用、生态环境持续改善和社会经济可持续发展为目标的湿地生态系统管理理念,已在一些发达国家被广泛接受,以全湿地为尺度进行湿地生态系统管理成为现今湿地管理的趋势和方向。湿地生态系统管理是一种全新的管理理念,该理念强调以生态系统整体健康为目标,从湿地生态系统整体出发,综合考虑生态系统中的各要素,保障湿地生态系统的平衡和稳定,推动社会发展与生态相互协调,实现资源可持续利用。因此,有必要从东平湖湿地生态系统的现状入手,以湿地生态系统整体保护为着眼点,结合国内外生态系统管理的先进理论方法和经验,努力从生态系统管理实践操作层面寻求适合该地区湿地生态环境保护的具体途径,创立一种跨越部门、行业和区域的可持续的湿地生态系统综合管理框架,以促进该地区经济、社会和环境的和谐发展,保障湿地整体利益的实现。
[Abstract]:Dongping Lake wetland has a long history and rich biological resources. It is an important part of urban wetland ecosystem. It provides water resources, regulates climate, conserves water sources, equalizes water supply and degrades pollutants. Biodiversity conservation plays an important ecological role. However, under the joint action of many factors of natural and social economic development, the ecological environment and function of wetland continuously deteriorate, which directly affects the evolution and development of wetland organisms. The wetland ecosystem shows that the water quality is serious eutrophication. The ecological environment is broken, fragmented, animals, plant species are on the verge of extinction, sediment pollution and other serious damage, resulting in the decline of wetland ecosystem anti-interference ability. At present, all kinds of ecological problems existing in wetland highlight the shortcomings and defects in the legal protection of Dongping Lake wetland, which brings many difficulties to the practical management of the wetland according to law. The weakness and deficiency of the traditional single ecological environment protection and management measures, including the legal approach of ecological environment, are all due to the lack of a concept of integrated protection of wetland ecosystem. In recent years, the concept of wetland ecosystem management, which aims at the sustainable utilization of wetland resources, the sustainable improvement of ecological environment and the sustainable development of social economy, has been widely accepted in some developed countries. Wetland ecosystem management based on the whole wetland has become the trend and direction of wetland management. Wetland ecosystem management is a new management concept, which emphasizes the goal of overall ecosystem health, from the wetland ecosystem as a whole, considering all the elements of the ecosystem. Ensure the balance and stability of wetland ecosystem, promote social development and ecological coordination, and realize sustainable utilization of resources. Therefore, it is necessary to start with the present situation of Dongping Lake wetland ecosystem, focus on the whole protection of wetland ecosystem, and combine the advanced theory and experience of ecosystem management at home and abroad. Striving to find specific ways to protect the wetland ecological environment in the region at the operational level of ecosystem management practices, and to create a sustainable integrated wetland ecosystem management framework across sectors, industries and regions to promote the region's economy, The harmonious development of society and environment ensures the realization of the overall interests of wetland.
