【摘要】： 伴随着经济社会的高速运转,环境污染日益加重,环境问题迅速从地区性问题发展成为波及世界各国的全球性问题,环境危机威胁着全球的生态安全。除政府之外,环保非政府组织作为一支独立的环保力量,凭借自身的特点和灵活性,大量涌现于世界环境舞台,在环境保护领域内开展着多种多样的活动,发挥着越来越重要的作用。我国环保非政府组织是我国环境保护领域中的先导者,以其对环境保护的热情和积极行动,已经成为我国环保事业的重要力量。但是,相对于环保非政府组织比较发达的国家,约束和规范我国环保非政府组织生长发育的法律制度还存在许多不足。鉴于环保非政府组织对环境保护的重要性和现有的法律规定的不健全,如何用法律来解决困境、保障发展显得尤为重要。美国、日本和俄罗斯在环保非政府组织的法律保障方面都对它确立了一定的法律地位,赋予其无需事前审批就可以注册登记、获得资金支持和财税优惠等方面的权利,为环保非政府组织创造了宽松的发展空间。因此,要培养和鼓励公众环境保护意识,就必须要赋予环保非政府组织相应的法律地位。本文首先对我国环保非政府组织的涵义、特征、类型、产生、发展、地位、作用等基本问题进行了概述,分析了我国环保非政府组织存在的主要问题及其形成原因,在借鉴国外关于环保非政府组织的经验基础上,对我国环保非政府组织的法律地位进行了界定。
[Abstract]:With the rapid operation of economy and society, the environmental pollution is getting worse day by day, the environmental problem has developed rapidly from the regional problem to the global problem which affects the countries all over the world, and the environmental crisis is threatening the global ecological security. In addition to the government, environmental non-governmental organizations, as an independent environmental protection force, with their own characteristics and flexibility, have emerged in large numbers in the world environmental stage, carrying out a variety of activities in the field of environmental protection. Play a more and more important role. Environmental non-governmental organizations in China are leaders in the field of environmental protection in our country. With their enthusiasm and positive action on environmental protection, non-governmental organizations have become an important force in environmental protection in our country. However, there are still many deficiencies in the legal system of restricting and standardizing the growth and development of environmental non-governmental organizations in China. In view of the importance of environmental non-governmental organizations to environmental protection and the imperfection of existing laws and regulations, it is particularly important to use the law to solve the dilemma and ensure development. The United States, Japan and Russia have all established a certain legal status for environmental non-governmental organizations in terms of their legal protection, giving them the right to register without prior examination and approval, to obtain financial support and tax concessions, and so on. For environmental non-governmental organizations to create a loose space for development. Therefore, in order to cultivate and encourage public awareness of environmental protection, environmental NGOs must be given the corresponding legal status. In this paper, the meaning, characteristics, types, generation, development, status, role and other basic problems of environmental non-governmental organizations in China are summarized, and the main problems and their formation reasons are analyzed. Based on the experience of foreign environmental NGOs, this paper defines the legal status of environmental NGOs in China.
