海岛生态保护法律制度研究

【摘要】： 随着经济的发展以及体制的变迁,现行海岛生态保护法律制度已不适应时代需要,问题主要体现在立法体系的不完善、管理体制的不明确以及具体制度的不完备上。问题如不及时解决,势必会影响到海岛生态环境的有效保护、海岛资源的合理开发及海岛土地的科学利用,甚至会影响到国家经济、社会的可持续发展。如何建立健全海岛生态保护法律制度,就成了摆在当代中国法学工作者面前的一个重要研究课题。鉴于此,笔者认为有必要撰写本文进行专门研究。本文首先阐述海岛生态保护法律制度的内涵界定与理论依据,指出构建与完善我国海岛生态保护法律制度的必要性、可行性。其次,分析我国海岛生态保护的立法模式、法律渊源、管理体制、具体制度以及存在的主要问题。再次,比较分析国外海岛生态保护立法模式、管理体制以及具体制度,主要以美、英、加、澳、日、韩等国为例,针对上述国家海岛立法中的先进之处,笔者提出一些借鉴意见。最后,从立法模式、立法体系、管理体制、具体制度等四个方面论述完善我国海岛生态保护法律制度的几点创新建议。根据生态法律制度基本内涵,本文认为海岛生态保护具体制度的完备应当从以下四个角度来构筑:第一,保护环境、防治环境污染类法律制度,含环境影响评价制度、三同时制度、清洁生产制度、环境污染与破坏事故报告制度、海岛分类保护制度。其中环境影响评价制度、三同时制度、清洁生产制度、环境污染与破坏事故报告制度属于我国生态环境基本法律制度,由于海岛生态保护法属于生态环境法的一个研究方向,所以生态环境基本法律制度同时也是海岛生态保护法所应遵循的基本制度。第二,保护和合理开发利用自然资源类法律制度,含海岛资源权属制度,海岛资源恢复制度。第三,现代化国土整治类法律制度,含海岛利用规划制度,海岛自然保护区制度。第四,综合管理类法律制度,含海岛监督检查制度,海岛调查统计制度。通过比较分析国内外关于海岛生态保护的立法及相关研究,提出完善我国海岛生态保护法律制度的几点建议,以期抛砖引玉,促进对国家海岛生态保护法律制度的构建与完善,是本文之宗旨。
[Abstract]:With the development of economy and the change of system, the current legal system of island ecological protection has not been adapted to the needs of the times. The problems are mainly reflected in the imperfect legislative system, the unclear management system and the incomplete concrete system. If the problem is not solved in time, it will inevitably affect the effective protection of the island ecological environment, the rational exploitation of the island resources and the scientific utilization of the island land, and even the sustainable development of the national economy and society. How to establish and perfect the legal system of island ecological protection has become an important research subject in front of contemporary Chinese legal workers. In view of this, I think it is necessary to write this article for special study. This paper first expounds the definition and theoretical basis of the legal system of island ecological protection, and points out the necessity and feasibility of constructing and perfecting the legal system of island ecological protection in China. Secondly, the legislative model, legal origin, management system, specific system and main problems of ecological protection of islands in China are analyzed. Thirdly, comparing and analyzing the foreign island ecological protection legislation model, management system and specific system, mainly taking the United States, Britain, Canada, Australia, Japan, South Korea and other countries as examples, aiming at the advanced points in the island legislation of these countries. The author puts forward some suggestions for reference. Finally, some innovative suggestions on perfecting the legal system of island ecological protection in China are discussed from four aspects: legislative model, legislative system, management system and concrete system. According to the basic connotation of the ecological legal system, this paper holds that the perfection of the specific system of island ecological protection should be constructed from the following four angles: first, to protect the environment, to prevent and control environmental pollution, and to include the environmental impact assessment system. Third, simultaneous system, cleaner production system, environmental pollution and damage accident reporting system, island classification protection system. The environmental impact assessment system, the three simultaneous system, the cleaner production system, the environmental pollution and damage accident reporting system belong to the basic ecological environment legal system of our country, because the island ecological protection law belongs to a research direction of the ecological environmental law. Therefore, the ecological environment basic legal system is also the island ecological protection law should follow the basic system. Second, the legal system of protecting and rationally exploiting and utilizing natural resources, including the ownership system of island resources and the restoration system of island resources. Third, modern land regulation legal system, including island utilization planning system, island nature reserve system. Fourth, comprehensive management legal system, including island supervision and inspection system, island investigation and statistics system. Based on the comparative analysis of the legislation and related research on island ecological protection at home and abroad, this paper puts forward some suggestions on how to perfect the legal system of island ecological protection in China, in order to promote the construction and perfection of the legal system of island ecological protection in China.
