【摘要】：随着我国农村经济的快速发展,农村生活水平和农村生产力的日益提高,农村固体废物污染情况日益严重,农村固体废物污染环境已经成为固体废物污染中一个新的问题。而我国的农村固体废物污染环境防治立法存在诸多缺陷,例如,立法指导思想错位;缺少相关原则制度;法律责任不完善;综合性立法及配套立法缺乏等。面对诸多缺陷,本文旨在循环经济理念的指导下完善我国农村固体废物污染环境防治法律体系。文章共分四章:在本文的第一章,首先对农村固体废物的概念加以界定,在此基础上简要介绍了农村固体废物的种类,并分析了农村固体废物不同于其他固体废物的特点。其次,本章对我国农村固体废物污染环境现状做了介绍,并分析了导致我国农村固体废物污染环境现状的原因,关键是要明确完善我国农村固体废物污染环境防治立法是解决目前农村污染现状的基础和前提;第二章中介绍了我国目前农村固体废物污染环境防治的立法现状,包括了基本法、单行法、国务院行政法规和部门规章、地方性法规和规章以及其他法律中的相关规定,并按照内容、调整对象等进行了系统梳理;进而在第三章中评析了目前我国农村固体废物污染环境防治立法在指导思想、原则制度、法律责任及配套立法等方面的缺陷所在;最后本文在最后一章提出了完善我国农村固体废物污染环境防治立法的相关建议,即明确循环经济的立法指导思想,完善相关的法律原则、制度及配套法规。
[Abstract]:With the rapid development of rural economy, the improvement of rural living standard and rural productivity, the pollution of rural solid waste is becoming more and more serious. The environmental pollution of rural solid waste has become a new problem in solid waste pollution. However, there are many defects in the legislation of environmental prevention and control of rural solid waste pollution in China, such as the dislocation of legislative guiding ideology, the lack of relevant principles and systems, the imperfection of legal responsibility, and the lack of comprehensive legislation and supporting legislation. In the face of many defects, the purpose of this paper is to perfect the legal system of environmental prevention and control of solid waste pollution in rural areas under the guidance of the concept of circular economy. The article is divided into four chapters: in the first chapter, the concept of rural solid waste is defined, and on this basis, the types of rural solid waste are briefly introduced, and the characteristics of rural solid waste are analyzed. Secondly, this chapter introduces the environmental status quo of solid waste pollution in rural areas in China, and analyzes the reasons leading to the environmental pollution situation of rural solid waste in China. The key is to clearly improve the legislation of environmental prevention and control of rural solid waste pollution is the basis and premise to solve the current situation of rural pollution. Chapter two introduces the current legislative situation of environmental prevention and control of rural solid waste pollution in China. Including the basic law, special law, administrative regulations and departmental rules of the State Council, local laws and regulations and other relevant provisions of the law, and according to the content, adjust the object of a systematic comb; In the third chapter, the author analyzes the defects of the current legislation on the prevention and control of the environmental pollution caused by solid waste in our country in the aspects of guiding ideology, principle system, legal responsibility and supporting legislation. Finally, in the last chapter, the author puts forward some suggestions to improve the legislation of environmental prevention and control of solid waste pollution in rural areas, that is, to make clear the guiding ideology of legislation on circular economy, to perfect the relevant legal principles, systems and supporting laws and regulations.
